The Owner and the City desire to cnter into this Agreemcnt tn clarify their respective roles re�arding the Backwater Vaive. AGREEDI�NT For good and valuable consideration,the receipt and sufficiency of which are hereby acknowledged,the City nnd Owner agree as follows: A. Matntenance of Backwater Valve. The Owner is exclusivcly responsible for ihe maintenance of the Backwater Valve. Future ownera o£the Properiy cusume the responsibility for maintaming the Backwater Valve when lhey take ownecship of the Property. The Owner,on bchalf �f itself and on behalf of all future owneis of ihe Property,releases the City&om all - claims and liabilities arising from or relating to any failure to maintair,the uBackwater Valve by the Owner or by any future owner of the Property. Upon the Owner's request,U�e City will provide the Owner with educational brochures and other materials regazding Backwater Valve maintenance. B. Citv Rieht to Insnect• The Owner hereby granu permission for the City to enter upon the Property from time to time to inspect tSe Backwater Valve and the Properiy's othcr plumbing and drainnge syslems. This perntission remains in effect for as long as the Backwater Valve remains inslalled. The City may,but has no obligation to,perform maintenance orz the Backwater Valve dwing these inspections. C. Other. The Owner consents to mcording of ihis Agte�;menL This Agrecment n�c with the land and binds all of the Owner's successors-in-interest. This Agreement and the Inspection and Backwatcr Valve Agreement signed by the Owner and thc City contain the entire agreement beriveen the Ciry and the Owner relating to lhe Backwater Valve. No amendment or temunahon of this Agreement is eft'ective unless it is in wriUng and signed by the Owner and by the Mayor of the City. 2
