9 <br />c.. •a. /677 <br />REAG �'.POPE.C'%Y iSlfliUflE�.� <br />0E7T <br />3z00 cEDflc� s7.C'EF% n <br />PARKING EASEMENT <br />'� �KEGorzj� <br />For valuable consideration, the City of6Ever6tt, a munLi.pal <br />corporation in Everett, Washington (Grantor), hereby grants to the <br />Everett Lodge No. 479, Benevolent and Protective Order Of Elks, a <br />fraternal organization located in Everett, Washington (Gras tee), a <br />nontransferable exclusive easement for the use under the <br />limitations set forth below of all parking stalls in the multi- <br />level parking structure being constructed on the southeast corner <br />of Rucker and Everett Avenues, Everett, Washington, more <br />uarticularly described in Attachment A hereto. <br />The duration of this easement shall be five (5) years from the <br />date of recording. Grantor hereby grants to Grantee an option to <br />renew said easement for an additional five (5) years on the same <br />terms as set forth below, which option shall be deemed <br />automatically exercised unless canceled of record by the Grantee. <br />The legal description of the Grantee's property (the dominant <br />tenement) is more particularly described in Attachment B hereto. <br />Said easement is limited as follows: <br />a. Grantee may use said parking structure on Friday evenings <br />after 6:00 p.m., Saturday evenings after 5:00 p.m., and such other <br />days and times as will not conflict with usage by library patrons <br />or other City meetings, such times to be mutually agreed upon in <br />good faith. <br />b. Ten (10) years after the Closing Date, the Grantee and <br />Grantor may agree to renew this exclusive parking easement annually <br />on mutually acceptable terms. <br />C.
