Woolworth <br />861 Lawson Road <br />Camano Islan3, WA 9829i <br />hereinafter referred to as "Applicant," f.r�r a variance from <br />E.M.C. 19.40.020, Off-street Parking, to ailow the continuing <br />operation of a nine tenant roon:ing house with five off-street <br />parking spaces instead of the nine spaces required by code. <br />on the following described property: <br />The east 81 feet of Lots 17 and 18, Block <br />769, Plat of Everett. <br />Commonly �:nown as: <br />3i32 Hoyt <br />The Board of Adjustment, foZlowing a public hearing on said <br />application held on Octoher 10, 1988, and further having viewed <br />the site and reviewed all L•estimony, makes the following Find- <br />ings, Conclusions and order: <br />FTNDINGS AIVD CONCLUSIONS: <br />Criterion No. 1• <br />That there have been exceptional or ex�.raordinary circumstances <br />or conditions appiying to the subject property or as to the in- <br />tt�r+.ded use therecf that do not apply generaily to other <br />pruperties in the same vicinity or ..one. <br />a. Findings: The property consist� of a single family <br />structure that has been converted to a rooining house with <br />nine roomers. The conversion was done without obtaining <br />the proper permits. The City became aware of the <br />violation after the City Code Enforcement Officer <br />received c�mplaints about the tenants and the disposition <br />of garbage. <br />The zoning code requirement for parking is one space for <br />each roomer so nine parkinq sp�ces are required by code. <br />The former use of the building was a single family <br />residence which only required two off-street parking <br />spaces. The City Zoninq Code also requires that a Use <br />Permit be obtained when the use of a building chanqes to <br />a more intensive use. <br />In his ,iarrative statement, the Applicant contends that <br />his typical tenant does not own a vehicle. That on the <br />average for the past year not more than three tenants <br />have had vehicles at one time as these tenants can <br />t,arely afford to pay rent ar.d food are therefore not in a <br />gosition to own and operate a vehicle. In addition to <br />the lack of tenants w;th vehicles the property is located <br />on a corner lot with plenty of street parkinq. <br />Even though this particular owner may rent to low <br />income persons who generally do not owa automobiles; <br />tnere are other persons who may be lookinq for small, <br />low cosk t:ousing who do own cars at�3 a severe parking <br />problem coulci occur in the area because of this. In <br />addition, the Applicant has created his own hardship by <br />converting to a rooming house witiiout obtaining the <br />necessary permits, during which pr�� •^s he would have <br />become aware of the City code reyuirements before <br />making any substantial investment. <br />
