PLANNING DIRECTOR DETERMINATION <br />Review Process II #00-023 <br />INTRODUCTION: The City of Everett Planning Department received an application from <br />Marilyn Ceresa, 3331 Hoyt Ave, Everett, WA 98201, for a 13'-6" by 19' addition to the rear of <br />her ex,isting single family residence and an 8' by 11' shed. The existing residence is located <br />only one foc,t from the south side property line along 34'" Street SE and as close as only 3 feet <br />from the north side property line. The new addition will have the same setbacics as the house <br />along the south side property line and a 4-foot setback from the north side propertv line. The <br />sheo will meet all setback requirements except for a setback of 8'-7" from the south side <br />property line. The existing resid.nce was originally constructed in 1905 according to the <br />Snohomish County Assessor's records and has been certified as a legal non-conforming <br />structure (NCB#00-026). Sectiun 38.040 allows for the Planning Director to permit the <br />expansion of a structure which does not meet required setbacks or height, provided that the <br />expansion does not make the setback or height more nonconforming; that the expansion <br />complies with all other requirements of the zoning cocJe ordinance; and that the nonconformity <br />has been certified by the Planning Department. <br />FINDINGS: The pro�ert;i is located in the R-5, Multiple Family Residential Zone. The typical <br />reGuired setbacks from the interior side property line is 5 feet and 10 feet from the streei side <br />property line. The existing residence is located only one foot from the street side property line <br />and as close as 3 feet from the north side property line. It was originally constructed ir, 1905 <br />according to the Snohomish County Assesser's records. The zoning code requirements for <br />huilding setbacks for structures from side property lines became effective December 1, 1956. <br />DECISION: The Planning Director has determined to allaw for the proposal with the following <br />conditions: <br />All necessary building permits are to be obtained from the �ity of Everett's Building <br />Department. <br />Right to Appeal: The applicant or owner of property located adjacent to the subject property <br />or any property owner who deems himself aggrieved and wil! thereby suffer a direct impact <br />from the proposal may appeal the Planning Director's determination as to whether or not the <br />proposal should be permitted. Any such appeal must be filed within fourteen (14) calendar <br />days af the date specified below. Appeal forms are available from the Planning Department <br />and must be submitted along with the required filing fee.
