II. The Building Official has found the building o� <br />may endanger the life, health, property or safety c <br />dangerous pursuant to the provisions of the Abatement <br />Sec. 302, noting the foliowing: <br />3. <br />the above described property <br />[ the public and is rendered <br />of Dangerous Buildings Code, <br />The building exists in violation of specific requirements applicable to <br />such buildings provided by the building regulauons of this jurisdiction, <br />as specified in the Building Code and Housing Code as adopted by <br />Ordinance of this jurisdiction relating to the condition of buildings. <br />The building has become an at[ractive nuisance to children and a harbor <br />for vagranu. <br />The building is in such a condition as ro constitu[e a public nuisance <br />known to the common law or in equity jurisprudence. <br />III. The above-described building shall either be repaired in accordance with all <br />curren[ Building Code requirements and all other applicable codes or demolished. <br />IV. If the owner elects to repair the buildin� in accordance with the current Building <br />Code requirements, all required permits must be secured therefore, and the work <br />physically commenced within sixry (60) days of the date of this Order. All work must <br />be completed within ninety (90) days of the date of this Order. <br />V. If the uwner elects to demolish the building, all required permits shall be <br />secured therefore within thirry (30) days of the date of this order. Such demolitiun <br />must be completed within sixty (60) days Trom the date of this Order. <br />VI. Since the building is uninliabitable in its presen[ condition, it shall be kept <br />secured from unauthorized entry and remain vacant until such time as the building is <br />repaired in accordance with the current Building Code or demolished. <br />VII. If the requirements set foRh in Paragraphs IV, V and VI above are not complied <br />with, the City of Everett will order the building to remain vacated and proceed to cause <br />the building to be demolished and charge the costs thereof against the property and/or <br />its owner. <br />VIII. Any person having any record tide or legal interest in the building may appeal <br />from chis Not�ce and Order to the Housing Advisory and Appeals Board. Such appeal <br />must be in writing as is required in the Uniform Housing Code and filed with the City <br />of Everett Building Official witnin thiRy (30) days from the date of service of this <br />IQotice and Order. Failure to appeal wi11 consu[ute a waiver of all right to an <br />adrc�inistrative hearing and determination of ihe matter. <br />
