II. The Building Official has found the building o� may endanger the life, health, property or safety c dangerous pursuant to the provisions of the Abatement Sec. 302, noting the foliowing: 3. the above described property [ the public and is rendered of Dangerous Buildings Code, The building exists in violation of specific requirements applicable to such buildings provided by the building regulauons of this jurisdiction, as specified in the Building Code and Housing Code as adopted by Ordinance of this jurisdiction relating to the condition of buildings. The building has become an at[ractive nuisance to children and a harbor for vagranu. The building is in such a condition as ro constitu[e a public nuisance known to the common law or in equity jurisprudence. III. The above-described building shall either be repaired in accordance with all curren[ Building Code requirements and all other applicable codes or demolished. IV. If the owner elects to repair the buildin� in accordance with the current Building Code requirements, all required permits must be secured therefore, and the work physically commenced within sixry (60) days of the date of this Order. All work must be completed within ninety (90) days of the date of this Order. V. If the uwner elects to demolish the building, all required permits shall be secured therefore within thirry (30) days of the date of this order. Such demolitiun must be completed within sixty (60) days Trom the date of this Order. VI. Since the building is uninliabitable in its presen[ condition, it shall be kept secured from unauthorized entry and remain vacant until such time as the building is repaired in accordance with the current Building Code or demolished. VII. If the requirements set foRh in Paragraphs IV, V and VI above are not complied with, the City of Everett will order the building to remain vacated and proceed to cause the building to be demolished and charge the costs thereof against the property and/or its owner. VIII. Any person having any record tide or legal interest in the building may appeal from chis Not�ce and Order to the Housing Advisory and Appeals Board. Such appeal must be in writing as is required in the Uniform Housing Code and filed with the City of Everett Building Official witnin thiRy (30) days from the date of service of this IQotice and Order. Failure to appeal wi11 consu[ute a waiver of all right to an adrc�inistrative hearing and determination of ihe matter.
