That the authorization of such variance will not be materially <br />detrimental to the public welfare or injrious to property in the <br />vicinity or zone in which the property is located. <br />4. <br />a• Finding; Placement of a structure within 1.5 feet of the side <br />property line would not allow sufficient room for building <br />construction without requiring access onto adjoining property, <br />The Board has cummonly required a three foot setback in similar <br />circumstances. <br />b. Conclusion: Approval of the requested variance would be <br />detrimental to the adjoinin6 lot. A three foot setback would <br />not be injurious to property cr improvements in the area. <br />That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />a. <br />b. <br />Findir•�; Tha Comprehensive Plan designates the property for <br />single-famil,y residential use. <br />Conclusion: The requested variance is not in conflict with the <br />goals and poli.cies of the Comprehensive Plan. <br />NOW, THEREFORE� the Board of Adjustment of the City of Everect does <br />hereby order that the variance of Mary Servais and Ed Schulz frum Sec. <br />79.42.040 D to allow a detached garage to be built to within three feet of <br />the north side pt�operty line be GRANTED and furthe^ require the applicant to <br />meet the following conditions. <br />Pa <br />The building shall not be located closer than three feet to the <br />south side property line. <br />The applicant shall obtain all required permits from the <br />Building Department. <br />The action of the Board of Adjustment in GRANTING a variance shall be <br />I final and conclusive, unless within fifteen (15) days from the date of <br />I issuance and signing of this order by the Chairman of the Board, an <br />aggrieved person or persons obtains a writ of certiorari from the Superior <br />Court of Waehirgton For Snohomish County for the purpose of review of the <br />action taken. <br />DATED this �_ day of �(�A/�� , 7986. <br />D <br />Chairman, Poard of Adjustment <br />2489F -2 <br />
