PLANNING DIRECTOR DETERMINATION
Fence Modification
Review Process I #03-011
INTRODUCTION: The City of Everett Planning Department has received an application from
Frank Layden, 801 Laurel Drive, Everett WA 98201, to retain an existing five-foot high fence
within the front yard setback. Section 39.070.A.1 of the Everett Zoning Code grants the Planning
Director the ability to permit a fence to exceed the maximum allowable height of forty-two inches
within the front setback, through Review Process I as described in the City's Local Project
Review and Procedures Ordinance.
BACKGROUND: Section 39.070.A.1 of the Everett Zoning Code states that the maximum height
of fences located wi!hin the front yard setback shall not exceed forty-two inches in height unless
approved by the Planning Director using the review process described in the City's Local Project
Review and Procedures Ordinance.
The subject property is located at 801 Laurel Drive, in the R-1 Single Family Residential Zone.
The property owner has made application for a fence modification to retain a five-foot tall fence,
which is located within the front yard setback.
FINDINGS: The subject fence replaces a solid board fence which was previously constructed on
site. The new fence was located four feet closer to the residence than the previous solid board
fence. The new fence is black coated chain link, which allows for visibility of the subject
residence. The new fence has been reviewed and approved by both the City Public
Services/Engineering Department and the City Traffic Engineer.
DECISION: The Planning Director has determined to approve the application for the fence
modification based on the following conditions being met:
• The vegetation at the southwest corner of the site must be maintained at a height no
taller than three feet, in order to provide for a clear vision triangle. This triangle should be
formed by the intersecting street rights -of -way and the sides of the triangle measured
along the property from said angle a distance of fifteen feet.
This is an administrative decision that may be appealed to the City's Land Use Hearing Examiner.
An appeal must be filed with the City within 14 days of the date of this notice. If you have
questions regarding this proposal or if you wish to file an appeal, please contact Becky Fauver,
City of Everett Planning Department, at (425) 257-7281.
Date: April 30, 2003
Planning and Community Development Department
S:Wauver\Revl\Fence & Retaining WaIIW3-011 801 Laurel.doc
