PLANNING DIRECTOR DETERMINATION <br />Fence Modification <br />Review Process I #03-011 <br />INTRODUCTION: The City of Everett Planning Department has received an application from <br />Frank Layden, 801 Laurel Drive, Everett WA 98201, to retain an existing five-foot high fence <br />within the front yard setback. Section 39.070.A.1 of the Everett Zoning Code grants the Planning <br />Director the ability to permit a fence to exceed the maximum allowable height of forty-two inches <br />within the front setback, through Review Process I as described in the City's Local Project <br />Review and Procedures Ordinance. <br />BACKGROUND: Section 39.070.A.1 of the Everett Zoning Code states that the maximum height <br />of fences located wi!hin the front yard setback shall not exceed forty-two inches in height unless <br />approved by the Planning Director using the review process described in the City's Local Project <br />Review and Procedures Ordinance. <br />The subject property is located at 801 Laurel Drive, in the R-1 Single Family Residential Zone. <br />The property owner has made application for a fence modification to retain a five-foot tall fence, <br />which is located within the front yard setback. <br />FINDINGS: The subject fence replaces a solid board fence which was previously constructed on <br />site. The new fence was located four feet closer to the residence than the previous solid board <br />fence. The new fence is black coated chain link, which allows for visibility of the subject <br />residence. The new fence has been reviewed and approved by both the City Public <br />Services/Engineering Department and the City Traffic Engineer. <br />DECISION: The Planning Director has determined to approve the application for the fence <br />modification based on the following conditions being met: <br />• The vegetation at the southwest corner of the site must be maintained at a height no <br />taller than three feet, in order to provide for a clear vision triangle. This triangle should be <br />formed by the intersecting street rights -of -way and the sides of the triangle measured <br />along the property from said angle a distance of fifteen feet. <br />This is an administrative decision that may be appealed to the City's Land Use Hearing Examiner. <br />An appeal must be filed with the City within 14 days of the date of this notice.
