PLANNING DIRE.�TfJR DECISION <br />REVIEW PROCESS I #5-97 <br />March 24, 1997 <br />The City of Everett Pianning Director grants approval of a request by <br />Gary Jellison to reduce the standard 50 foot wide buffer required from <br />the edge of a Category ill wetland to 25 feet in order to construct a <br />duplex at 2016 Liraoln Street with the following conditions: <br />1. The remaining 25 foot wide buffer from the wetland must he enhanced <br />wrth native vegetaiion per iiie c�jJfuveu uuiiei ciliiallGriiiciu Nici� uy �noyii <br />Snohomish Design Group. The buffer enhancement must be completed <br />pror to the issuance of Building Department permits or a bond worth 300% <br />of remaining improvements must be submitted to the Planning Department. <br />2. Pr�vide a recorded Environmentally Sensitive Area Covenant to the <br />Planning Departmeni prior to issuance of Building Department pertnits. <br />3. Provide a temporary erosion control fence along the approved stream <br />and wetland buffer boundary prior to c;earing and grading of the property. <br />The location of the fence must be verified by the City's Environmental <br />Planner prior to clParing and gradir�g. <br />4. Provide a permanent fence along the approved stream and wetland <br />buffer boundary as shown on the approved si:e plan. Solid board, post and <br />rail, chain link, picKet fence or other type of fence that is acceptable to the <br />Planning Department shall be used. Post an environrc�antally sensitive area <br />sign on the fence. <br />5. Comply with the recommendations of the geotechnical study by Earth <br />Consultants Inc., dated March 13, 1997. The foundation must be inspected <br />and certified by Earth Consultants, Inc. <br />6. Sign a hold hartnless agreemen� with the City in a form approved by the <br />City Attorney prior to i�suance of building permits. <br />7. Drain the seeps on this lot into the Ca?egory III wetland. Seeps on the <br />lots to the west (2008 Lincoln) and northwest (2002 Lincoln) must be drained <br />in acccrdance to Public Works requirements. <br />Subsection 37.100.D gives the Planning Director the authority to allow the <br />reduction of buffer only when there has previously been substantial legal <br />alteration of the buffer. The Planning Director approve�l the reduced buffer <br />based upon the fo!lowing: <br />The wetland and buffer have previously been disturbed. The disturbance <br />appears to be similar to an aeri�l photo of the city dated 1981. The buffer <br />consist mainly of blackberry. An enhancement plan has been submitted that <br />
