-3- <br />A hearing was held on the application of Samuel Steinmann, 17817 <br />Wayne Avenue N., Seattle, Washington 98133, for a variance from <br />Section 19.14.OSO of the Everett Municipal Code, Yard Requirements, <br />Paragraph A, for permission to demolish the existing residence and <br />be*able to build a new single family residence and use the existing <br />front yard setback which is within one (1) foot of the front property <br />line rather than the code requirement of twenty (20) feet from the <br />front property line. <br />Legal Description: Lot 31 IbbersG. k <br />Zoning: R-1 Single Family Low Density Residence <br />Address: 11401 IV. Ibberson Drive <br />A letter from the City's Public Works Department was read into <br />the record and they recommended the Board grant the one (1) foot <br />side yard variance and the appl-icant submit a new variance request <br />for West Ibberson Road setback. <br />Mr. Steinmann represented himself with the assistance of James <br />Irvine and some of their comments were as follows: <br />1. The property was purchased twelve years ago. <br />2. There is some confusion on the frontage road. <br />3. There is a front yard area of considerable size that <br />follows the diagonal contour of the lake that is City <br />owned property. tl <br />Mr. Irving, a neighbor, stated that Ibberson Road is a permanently 4 <br />dedicated road for all public use. j <br />a <br />Mr. $ Mrs. Metz, neighbors on West Ibberson,Drive, made the following <br />statements: <br />1. There is a better understanding needed on the side yard p <br />setback and road right-of-way along West Ibberson Drive. <br />2. They do not want to have any houses closer to West <br />Ibberson Drive. <br />3. There is a dedicated forty foot road in front of <br />Mr. Steinmann's residence, then a common beach in front <br />of the dedicated road. <br />Mr. Spaine, an adjacent property owrer, said the road in front of <br />the applicant's property is owned by the adjacent property owners, <br />the owners of property within the tract have an undivided interest <br />'in the road. <br />The Board members then established the front yard of Mr. Steinmann's <br />property is facing the lake, and for all practical purposes the <br />public right-of-way is in front as the road use indicates. <br />
