EASEME:VT <br />This easement is granted subject to and conditioned upcn the following terms, conditions and <br />covenants: <br />1. Grantor shall at all times conduct iu activides and all other activities conducted on <br />Grazitor's property so as no: to interfere with, obs�uct c. endanger the usefiilness of any <br />improvements, or other facilities, now or hereafter maintained upon the easement, or in any way <br />interfere with, obstruct o: endanger the City's use of the easement. <br />2. Prior to any conshuction, work nr any other activiry by Grantor within tl�e easement, <br />notification and plans for the same shall be submitted in writing to the City 5y Grantor and no <br />such conshvction, work or activity by Grantor shall be commencEd wi[hout Ciry's prior written <br />agreeme�t that the Grantor's proposed constr-iction, work or activiry will not interfere with the <br />City's easement granted herein; PROVIDED, HOWEVF.R, any changes or revisions in the plans <br />shall also be subject to City's prior agreement. The City's review of the Grantor's plans under <br />this easement shall not be deemed to impose any duty or obligatiun on the Ciry to determine the <br />adequacy or sufficiency of Grantoi s plans and designs nor whether Grantor's construction, work <br />or activiry is in conformance with other applicable plans, codes and regulations. Further, <br />agreement by the Ciry to such eonstruction, work or activiry �hal! not in any mannec be <br />considered as imposing an}• obligation, duty or liability upon the City as to the safety or <br />propriety of such construction, wor�C or activity. � <br />3. Grantur hereby auchorizes City to cut, trim and remove any and all brush, trees, other <br />vegetation or debris upon the easement and the right of access for such purposes. Grantor also <br />authorizes the City to cut, trim and remove any and all brush, �ees, other vegetation and debris <br />on Grantor's property which, in the Ciry's reasonable jud¢ment, constitutes a hazard to the <br />easement and the right of access for such purposes. <br />� <br />99�C��8���� <br />
