REQUEST <br /> Mr. Sage requests permission to build a single-family dwelling to <br /> within six (6) feeF of the rear property line rather than the <br /> minimum requirement of twenty t20) feet. <br /> I I . ARGUP�IENTS I N FAVOR <br /> A. The pe,:uliar rectangular shape of the property makes it difficult to <br /> build within the required yard setbacks. <br />�� B. The height of building is restricted to a total height above ground level <br />'><� to 16'9". There will be no sight obstruction to neighboring properties. <br /> C. The rea; yard abuts a bluff and thus no houses could conceivably be <br /> built on the adjacent property. The need f�� a rear yard setback is thus <br /> reduced. <br /> I I I . ARGU�1ENTS P.C,A I NST <br /> A. The owner of the property should have known before purchasing the property <br /> that the lot was unbuildable. <br /> B. A smaller house could be constructed on the property and meet the present <br /> yard setback requirements. <br /> IV. FOSSIBLE FINDING; <br /> A. There are exceptional circumstances appiying to the subject property that <br /> does not apply to other properties in the same vicinity; specifically, <br /> the lot is an unusal sliape and there is a bluff that does restrict the <br /> required setback and development on adjacent nroperties. <br /> B, A hardship does exist to the owner of the property as the use of the <br /> property woulJ be diminished if the required yard setbacks must be ad- <br /> hered to.* <br /> C. This will be a better division and utilization of the property. <br /> [J. The authorization of such variance will not be detrimental to adjacent <br /> �roperties due to the deed restriction on height, on the unbreakable <br /> nature of surrounding properties. <br /> �Under finding "B" in the Zoning (lydinance: There does not appear to be any <br /> "substantial property right possessed by the owners of other properties" that would <br /> be preserved by the granting of this variance. <br />
