Haggard <br /> 2903 Hewitt Ave. <br /> Everett, WA 98201 <br /> � hereinafter referred to as "Applicant," for a variance from <br /> Section 20, Use Standards Table, Side Setback and from Section <br /> 15.060, Additional Setback, to allow construction of an <br /> apartment that would have a zero foot west side setback instead <br /> of the ten feet required by code and from Section 15.030(A) , <br /> On-Site Open Space to allow individual open space areas of more <br /> than 100 square feet each instead of the minimum of one 500 <br /> square foot open space area permitted by code. <br /> on the property commonly known as: <br /> 1 1209 Hewitt Avenue (Lot 13, Block 671, Plat of Everett) <br /> The Hoard of Adjustment, followinq a public hearing on said <br /> application held on August 6, 1990, and further having reviewed <br /> all testimony, makes the follawinq Findinqs, Conclusions and <br /> Order: <br /> � <br /> FINDINGS AliD CONCLUSIONS: <br /> Criterion No. 1: <br /> That the variance is necessary because of exceptional or ex- <br /> traordinary circumstances regarding the size, shape, <br /> topography, or location of the subject property; or the loca- <br /> tion of a pre-existing improvement on the subject property that <br /> conformed to the zoning code in effect when the improvement was <br /> constructed. <br /> a. Findinas: The Applicant is proposing an innovative design <br /> for an apartment on a 24 foot by 12o foot lot (2880 square <br /> feet) . The maximum number of units permitted by code <br /> would be three since 750 square fer_t of lot area is <br /> required for each dwelling unit. The structure would be <br /> three-story with parkinq on the first floor, living area <br /> on the second floor, bedrooms on the third floor, and a <br /> deck with roof qarden on the roof. As proposed, each <br /> apartment would have 1,050 square feet of living area, a <br /> 60 square foot deck in addition to the roof garden, and a <br /> i two car garage. <br /> � The site is bordered on the east by the alley and on the <br /> ! west by a vacant lot. Even though this is a commercial <br /> zone, residential use is permitted. Because of the small <br /> i size of the site commercial uses are precluded by the <br /> parking requirements which realistically can be met only <br /> by using the first floor for parkinq, a situation which <br /> can be accommodated by a residential use. <br /> Because of the small lot size, the applicant is requesting <br /> variances as follows: <br />
