<br /> C. By this writing, the parties wlsh to provtde an easement appurtenant for purposes
<br /> of emergency ingress and egress to meet the requlrements of all permitting authoriUes and
<br /> the lnsurance carr.ers for John &Mary Bennett and HORSESNOE FM'ERpRISES, u,C, the owners
<br /> of the dominant estate.
<br /> Now, tMere(ore, for mutual consideration received, the sufficlency of whtch is acknowl-
<br /> edged, the partles agree as follows:
<br /> 1. COMMERCE BUILDING LIMITED PARTNERSHIP, hereby grants an non-exclusive ease-
<br /> ment appurtenant for emergency pedestrian ingress and egress over and through that por-
<br /> tton:o/' the servtent estate reasonabiy necessary to fuiff►► ihe purpose of thls easernent.
<br /> Presentiy, that pon(on begtns at an extsttng door in the easternmost edge o(the Commerce
<br /> Buti ng (situate on the servient estate) proceeding westward through the Commerce Bulid-

<br /> use permitted by this easement shall apply to the owners of the dominant estate, thelr ten-

<br /> 2. The parUes agree that it is their intent to provide an easement (n the form and
<br /> content necessary to meet the requirements of all permitting authortties and the insurers of
<br /> the dominant estate and its tenants. They agree they shall cooperate in modifyfng thls
<br /> agreement as necessary to fulfiq this easement's intenL including (but not llmited to)
<br /> meeting all insurance, government, and permitting authority requirements.
<br /> 3. John and Mary Bennett, as owners of the dominant estate, agree as part of the
<br /> conslderatton for this easement, the dominant estate shall:
<br /> a. defray and pay for all mechanical, electrtcal, slgnange and any other ex-
<br /> penses necessary for compliance with the requirements of all permitting
<br /> authoritles;
<br /> b. limit the hours of operation of any business on the dominant estate and
<br /> tenant to those approved by the servient estate.
