1 being an adjoining and adjacent property owner to the Southwest <br /> ' 2 objected to the granting of the variance; <br /> 3 Such objection was disre.garded and the variance was granted <br /> 4 by the Board of Adjustment and the number of parking spaces was <br /> S by said Board of Adjustment determined .to be 45 rather than 68 <br /> 6 according to code requirements by zeason of square footage of the <br /> 7 buildings errected and to be errected upon the said described <br /> 8 real property and such was reduced to the number of parking spac2s <br /> g of 25; <br /> 10 That in making the aforenentioned disposition of said proceed- <br /> 11 ings and granting said varia.nce the Board of Adjustment of the <br /> 12 City of Everett erred in the following particulars : <br /> lg (a) Said meeting was not held in cunfornance to the <br /> public meetings act in that although a public <br /> 14 meeting was i:� grogress, the comments and remarks <br /> of the members of the Board of Adjustments in <br /> 15 official session were not recorded by tape, device <br /> or by verbatim record, but, to the contrary, said <br /> 16 comments were conducted by .the Board of Adjustment <br /> talking anongst themselves in such a manner as to <br /> � 17 ic3ke sure their comments were not heard by the <br /> members of the audience present, nor, as aforesaid <br /> lg possible to be taken down as a record, and, in <br /> effect, were conducted as if in a� private room <br /> lg without the public present because said comments <br /> were not audible to either the recording device <br /> 20 or perspn nor to the public but only to the members <br /> of the Board as they discussed the facts; <br /> 21 • <br /> (b) That said Board of Adjustment, being a quasi-judicial <br /> 22 body did ,not conform to la�a in that it made no <br /> findings of fact but onJ.y r.ade legal conclusions in <br /> 23 the words of the code itself; <br /> 24 (.c) That the fact of the matter is said described <br /> premises after the expansion of the present birilding <br /> 25 located thereupon has room for only 20 vehicles to <br /> be parked and the Board of Adjustment in reducing <br /> . 26 the requirement of parked vehicles or parking spaces <br /> to 25 3isregarded the fact that said premises cannot <br /> 27 � conform to the requirements uf the variance as <br /> granted; and <br /> 28 <br /> AFFIDAVIT IN SUPPORT -2- <br />
