" (at p.22) ' <br /> i The Everett Municipal Code, Section 19. 70. 060A, in autho:izin�� <br /> i <br /> i <br /> I the Hoard of Adjustnent to grant variances, states: <br /> '�he board may authorize variances in specific cases <br /> from the provisions or. requirements of this title not <br /> otherwise restricted in this section, as w�ll not be <br /> contrary to the public interest; but only where, owing <br /> � to special conditions pertaining to a specific piece <br /> of property, the ].iteral enforcement of the provisions <br /> or requirements of this title would cause undue and <br /> unnecessary hardship. That such variance is necessary for the preser- <br /> vation and enjoyment of a substantial property <br /> right of the appellant possessed by the oM�ners <br /> of other properties in the same vicinity or <br /> zone. <br /> 3. That the authoriz�tion of such variance will <br /> not be materially detrir�ental to the public <br /> welfare or injuricus to property in the vicinity <br /> or zone in whicl� the property is located; <br /> 9 .
