(7) The City of Everett is authorized to deduct and retain oue of the monics which may be due and become due to the Contractor under thia Contract, as daoagea for the non—comnletion of the �rork aforesaid within the time hereinbefore stipulated for its completion, or within such further tiu�ea as in accordance with the provisions of the Contract, shall be fixed or allowed for such performance or completion, the sum of Fifty Dollars ($50) for each and every day the time employed upon said work may be increased as hereinafter provided, said sum of Fifty Dollars (s50) per day being hereby, in view of the difficulty of estimating such damagea, agreed upon, fixed and determined betcreen the parties hereto, as the liquidated damages that the City of �erett may suffer by reason of such default, and nat by way of penalty. (8) Prior to the demolition or removal of any structure, side sewers, or private sewer linee conaected to the public sexer syatem stiall be capped at the property line or as directed by the City's Public Works Department. The Contractor further agrees to indemnify and save the City, ita officera, employeea, and agents harmless from and against any and all liability, Iose, damage, expenae, action, and claim including coeta and reaeo¢able attorneq's fees incurred by the City, its officers, employeea, and agente as a result of any acta or omieaions oa the part of the Contractor, subcontractors, agewt employees, or pereons rrorking directly or indirectly for the Contractor in the performance of thia Contract. The Contractor agrees to repair aad replace all property of the CSty and property of othera damaged or deetroyed by 1Limaelf/heraelf, his/hec employeea, subcontractors, and agenta.
