r <br />O O <br />(5) Seller will pay any and all taxes imposed upon the sale <br />of the houses, garages and buildings. Purchaser %hall pay any <br />and all costs and taxes incident to removing the houses, garages <br />and buildings from their present location. a <br />(6) Purchaser agrees to hold and save harmless the Seller <br />from any and all liability claims, demands, causes of action and <br />possible causes of action whatsoever, arising out of or related <br />to any loss, damage or injury sustainvd to any person or property <br />owners] 1p or/ <br />arising from or occasioned by Purcha ser/removal of the houses, <br />garages and buildings from the real property, and shall, after <br />reasonable notice thereof, defend and pay the expense of defend- <br />ing any suit which may be commenced against the Seller by any <br />third person alleging injury by reason of the acts or omissions <br />4 Purchaser, Its employees, agent., contractors, subcontractors <br />or bssigns, and will pay any judgment which may be obtained against <br />the Seller in such suit. <br />(7) Tim 1s of the essence of this Contract, and it is <br />agreed tlat in case the Purchaser shall fail to remove the houses, <br />garages and buildings from the real estate within ninety (90) <br />days from the date hereof, the Seller may elect to declare all <br />of the Purchaser's rights hereunder terminated, and upon Seller's <br />doing so, all payments made by the Purchaser shall be forfeited <br />to the Seller as liquidated damages, and the Seller shall have the <br />right and title to the houses, garages and buildings which are the <br />subject of this Contract, which title shall revert to Seller. <br />' (9) In the event either party should breach this agreement, <br />the prevailing party in the event legal action is undertaken, <br />shall be entitled to all costs, disburaonents and reasonable <br />attorney's fees connected with such suit, which sums :.hall be <br />included in any judgment or decree entered in such suit. <br />(9) This Contract may be modified by mutual agreement of <br />the parties in writings said modification shall be attached to <br />this agreanent and shall thereby becume in full force and effect <br />' SALS OP BUILDINGS - g <br />8003210 20 3 sot 1GW PAC11,%3 <br />�., <br />!J4„w.1.YefiL�vn��...ry� ry Y N <br />ilb <br />
