Kunkel: <br />COO You an hereby notified that as of the Lire and date of receipt of this document all <br />rights of K s J Construction, Inc. under Contract dated October 11. 1976. by and <br />between Associated Developrant, Inc. as Seller, providing for the :ale to K K J <br />Construction, Inc., as Purchaser cf the following described Property situate in <br />Snohomish County, Washington: <br />'The hou es, garages, and other buildings located on Lots 18. 19. 20. <br />and 21. Block 1, Bevjrly Hills Division No. a, Snohomish County, Wash- <br />ington.- <br />are teminated. <br />This teroination is due to the failure of K K J Construction, Inc. to com;la with <br />paragraph 7 of the Contract referred to above, wncrein K s J COnstmction, Inc. <br />agreed: <br />'(7) Time is of the essence of this Contract, and it is agreed that in <br />case the Purchaser shall fail to renove the houses, eararea and buildings <br />from the real estate within, ninety (90) days free the date hereof, the <br />Seller my elect to declare all of the Purchaser's rights hereunder tem. <br />tooted, and upon Seller's doing so, all payments grade by the Purchaser <br />d all be forfeited to the Seller as liquidated damages, and the Selle <br />$hall have the right to the houses, garages and buildings wl ich are t, <br />'subject of this Contract, which title shall revert to Seller.' <br />Therefore, title to any regaining houses, garages or other buildings rewining on <br />the above described property hereby reverts to, and vests in, the Seller, Associated <br />Develop ont. Additionally, all payments received as of this date form K a J <br />Construction, Inc. are claimed by Associated Developcant, Inc. as liquidated damges <br />pursuant to paragraph 7, of the above referred to Contract. <br />By way of this letter.
