EASEII�NT <br />4. The Grantor agrees that dtle to all brush, uees, other vegetation or debris trimmed, <br />cut and removed from the easement pursuant ro this Agmment, and also all brush, trees, <br />other vegetation or debris trimmed, cut and removed from Grantor's land pursuant to this <br />Agrcement is vested in the Ciry, and that the consideratioa paid for conveying said easement <br />and rights herein described is accepted as full compensadon for all damages incidental to the <br />ezercise of any of said rights. <br />5. In the event Grantor places any improvemenu on or in the easement or conctructs <br />anything within the easement without first having obtained the written approval of t6e City <br />Engineer, the Granror shall cease all such acdvity and remove any and all improvemenu <br />placed therein without the written agrcement of the City Engineer. In the event Grantor fails <br />to obtain prior approvai, Grantor hereby authorius the City to remove any and all <br />improvements placed or construcud therein and hold the City, its officers, employxs and <br />agents harmless from damage caused to said improvements from removal thereof. Grantor <br />further agrees to pay the Ciry for any and all cosu incurred by the City in removing the <br />improvements. This right is in addition to any other right the City may have at law or in <br />equity. <br />6. Graator dces release, indemnify and promise to defend and save harmless the Ciry, <br />its officers, employees and agents from and against any and all liability, loss, damage, <br />expense, actions and claims, including costs and reasonable attorcey's fees incurred by the <br />City, iu o�cers, employees and agents in defense t6ereof, asserting or arising direcdy or <br />indirecdy on account of or out of Grantor's use or acdvity within the above-described <br />easement.
