K\SN:HGTCh - - <br />At the City Council study session of August 19, Councilman Michelsoa <br />requested that the application for a permit for a truck scale be <br />put upon the City Council agenda for consideration_. A brief sum- <br />mary of the situation follows. <br />The applicationAfor a ce»ercial truck scale to be located on the <br />westerly side of Hill Street, south of Pacific Avenue. The new <br />scale would be located approximately 20' northerly of an existing <br />truck scale. These scales are situated in a pit beneath the sur- <br />face of Lhe street with the platform flush with the surfacing. <br />The existing scale was installed in approximately 1955 under per- <br />mit from the City ^ouncil. <br />IIill Street is an industrial street with no curbs or gutters. The <br />existing and proposed scale locations are adjacent to the property <br />line and are located behind a utility pole line. Because the area <br />in question is presently industrial and wi2.1 probably continue <br />with this usage, I can see no particular objection to the grant- <br />ing of the permit; aside from the following: <br />1. Granting of the permit creates and perpetuates the usage <br />of the public rights -of -way for private purposes. Unless <br />there was good and substantial reason for the granting <br />of the permit, a very dangerous precedent could could <br />be set. <br />2. A substantial cost will be incurred by the property owner <br />in making this installation. Since the scales will be <br />located within the public right-of-way, a condition of <br />the permit should be the removal and the restoration to <br />the original condition in the event the right-of-way is <br />needed by the City. In order to prevent future complications <br />caused by the property changing ownership, the agreement <br />or permit containing this condition should be recorded. <br />A definite policy should be established regarding the use of pub- <br />lic rights -of -way, the procedure to follow in order to obtain <br />pernif.ssion to use the right-of-way and renumeration, if any, for <br />the use of this rights -of -way.
