DRAFT
August 25, 1970
TO• Mayor Anderson and )Mary Haglund
PROM• BEJ
RE: Suggested private use of public right of way policy
A suggested policy for review of questions involving private use of public
right of way is as follows:
1. All private use of public right of way, except driveway permits
and minor excavations presently covered by ordinance procedure, should
be granted by Council permit issued on a case by case basis. In other
words, the applicant would submit his application to the Mayor, or the
Mayor's authorized representative, and the Mayor will review and recommend
to the Council whether the permit should be granted and upon what terms
and conditions.
2. Any use of public right of ways should not: interfere with any
anticipated use or operating use by the City, or City franchisees.
3. The City should be completely indemnified for the use.
4. The permittee should agree to clean up after his use and put the
property back in the same condition as it was when he put his improvement
thereon.
5. Pees should be charged based on the anticipated income to the
permittee.
G. The permit should be revocable at the discretion of the City.
BEJ/bj
