DRAFT <br />August 25, 1970 <br />TO• Mayor Anderson and )Mary Haglund <br />PROM• BEJ <br />RE: Suggested private use of public right of way policy <br />A suggested policy for review of questions involving private use of public <br />right of way is as follows: <br />1. All private use of public right of way, except driveway permits <br />and minor excavations presently covered by ordinance procedure, should <br />be granted by Council permit issued on a case by case basis. In other <br />words, the applicant would submit his application to the Mayor, or the <br />Mayor's authorized representative, and the Mayor will review and recommend <br />to the Council whether the permit should be granted and upon what terms <br />and conditions. <br />2. Any use of public right of ways should not: interfere with any <br />anticipated use or operating use by the City, or City franchisees. <br />3. The City should be completely indemnified for the use. <br />4. The permittee should agree to clean up after his use and put the <br />property back in the same condition as it was when he put his improvement <br />thereon. <br />5. Pees should be charged based on the anticipated income to the <br />permittee. <br />G. The permit should be revocable at the discretion of the City. <br />BEJ/bj <br />
