� � <br /> <: ...;_ <br /> PLANNING UIRECTOR DETERMINATION <br /> Expansfon of Non-conforming Buildfng Setbac <br /> Review Pro�cess II #00-020 <br /> INTRODUCTION: The City of Everett Planning Department has received an application from Chris and Della <br /> Haesler, 2026 East Grand Avenue, Everett, WA 98201, to expand an existing 12'X 20'3"garage to a new <br /> dimension of 22'3" X 29'10". The existing garage slructure has zero setback from the street side property line. <br /> The expansion would continue to the east along this zero setback line. Section 38.040 allows for the Planning <br /> Director to approve the expansion of a structure which dces not moet required setbacks, provided that the <br /> expansion does not make the setback more nonconforming; that the expansion complies with all other <br /> requirements of the zoning ordirance; and that the nonconformity has been certified by the Planning <br /> Department. <br /> BACKGROUN�: The properry is iocated in the R-2, Single Family Detached Medium Density Zone. The <br /> required sr.tback is 10' from a street side property line for all structures. There is one existing garage, as well <br /> as an existing 325 square foot accessory structure on site. The subject garage is 12' wide by 20'3"deep and <br /> 243 sq.h:. in area. It is located at the southwest comer of the property, with zero setback along the side <br /> property line. according to Snohomish County Assessor's Records this structure was built in 1930. This <br /> structure is ccnsidered legal non-conforming or"grandfathered" as it predates the City's zoning code <br /> requirement for structures to have a minimum setback of ten feet (10') from the exterior side property line. The <br /> applicant proposes to make an addition of 10'3"X 29'10"to the existing garage. The new structure will have <br /> zero setback from the south side property line, consistent with the existing structure. <br /> FINDINGS: The existing garage has been certified as legal nonconforming relatbd to setbacks (NCB #00- <br /> 023). The applicant proposes to make an addition of 10'3" X 29'10"to the existing garage. The new structure <br /> will have zero setback from the street side property line consistent yvith the existing non-conforming setback, <br /> and will not create any further non-conformities than presently exists. <br /> DECISION: The Planning Director has determined to allow for the proposed addition to the existing accessory <br /> building with zero setback from the southem (side) property line with the following condition: <br /> • Necessary building permits are to be obtained by the applicant from the Cily of EveretPs Building <br /> Department. <br /> • Maximum heiyht of the new detached structure is 15' above base elevation. <br /> • The new accessory building/garage must be constructed of a building material similar to the house, <br /> as well as having a similar roof pitch to that of the house. <br /> Right to Appeal: The applicant or an owner of property located adjacent to the subject property may appeal the <br /> Planning Director's determination as to whether or not the proposal should be pertnitted. Any such appeal <br /> must be filed within fourteen (14) calendar days of the date specified below. Appeal fortns are available from <br /> the Planning Department and must be submitted along with the required filing fee.
