PLANNING DIRECTOR DETERMINATION <br /> Review Process II #99-038 <br /> INTRODUCTION: The City of Everett Planning Department has received an applica8on from <br /> Gannadly 8 Vera Kondyukov, 2218 East Grand Ave, Everett, WA 98201, to remodel an exisdng <br /> garage to be used for a family room and laundry room. As part of the remodel, part of the structure will <br /> removed to provide the required 5 feet setback frc�n the north side property line. The non-confortning <br /> setback from the rear property line will remain the same. The existing structure was originally <br /> constructed in 1920 and has been certified as a legal non-confortning shucture(NCB#99-028). Section <br /> 38.040 allows for the Planning Director to pertnit the expansion of a structure which does not meet <br /> required setbacks or height, provided that the expansion dces not make the setback or height more <br /> nonconforming; that the expansion complies with all other requirements of the zoning code ordinance; <br /> and that the nonconformity has been certified by the Planning Department. <br /> BACKGROUND: The property is located in the R-2, Single Family Residential Zone. The typical <br /> required setbacks from the front and rear property Ifnes is 20 feet and 5 feet from the side property <br /> lines. According to the applicanPs infortnation the existing residence and garage structure is located <br /> approximately 5 feet from the rear property line along the alley and only 1 foot from the nor'Ji side <br /> property Iine. It was originally constructed in 1920 according to the Snohomish County Assessor's ' <br /> records. The zoning code requirement for a minimum 20-foot setback from a rear property line and a 5- <br /> foot building setback for structures from a side property line became effective December 1, 1956. <br /> FINDINGS: The existing residence does not meet the required 20 foot rear setback and 5 foot setback <br /> from the north side property line. This structure's setbacks have been certified as legal nonconfortning <br /> (NCB #99-028). The applicant proposes to remodel the garage portion of the structure to be used for a <br /> family room and laundry room. As part of the remodel, part of the structure will removed to provide the <br /> required 5 feet setback from the north side property line. The non-confortning setback from the rear <br /> property line will remain the same. <br /> DECISION: The Planning Director has determined to allow for the proposed addfHon with the <br /> following conditions: <br /> 1. Necessary building permits are to be obtained from the City of Everett's Building Department <br /> prior to construction. <br /> 2. The minimum setback of 5 feet from the north side property line must be provided. <br /> 3. The new parking area on the south side of the house must accommodate two cars and be <br /> paved or concrete. <br /> NOTE: There Is an existing chainllnk fence that appears to be in the alley right-of-way and <br /> may need to be removed subject to Fire Department comments. <br /> Right to Appeal: The applicant or owner of property located adjacent to the subject property or any <br /> property owner who deems himself aggrieved and will thereby suffer a direct impact from the proposal <br /> may appeal the Planning Director's determination as to whether or not the proposal should be <br /> permitted. Any such appeai must be filed within fourteen (14) calendar days of the date spedfied <br /> below. Appeal forms are avaiiable from the Planning Department and must be submitted along with the <br /> required filing fee.
