Her <br /> neiqhbor to the south is Calvin D. ]fratz, 1504 Grand Avenue, Everett, <br /> Washinqton. In 1981 Mr. Eratz obtained a bnildinq permit to construct <br /> a carpart and deck at the rear of his house. This ia an R-2 sone <br /> requirinq a 5 foot setback. The construction violated that setback <br /> requirement by approximately 18". Mr, itratz was nc�ified of this <br /> violation, in writing, by the city attorney's offi�s on April 14, <br /> 1981. No further action was taken. <br /> Thereafter, Mr. Kratz has continued to remodel and expand the carport <br /> and deck. I believe that he has failed to obtain buildinq permits for <br /> this work. <br /> My client has sued Mr. Kratz under Snohrnaiah County Superior Court Cauae <br /> No. 84-2-02215-7. The trial is scheduled for September 11, 1965 at 9:30 <br /> a.m. You and Jim iles will be material witnesses at thia trial. l►lthough <br /> the city is not a defendant, I recoamnend that your office review the receni <br /> case of Radach v.
