Grand <br />Everett, HA 98201 <br />hereinafter referred to as "Applicant�" for a varianee from E.M.C. <br />19.22.060(B), Side Yard, 19•22.060 (C), Rear Yard, and 1g.42.040(D) yards to <br />allou: <br />a two-car garage to be built to the rear and side property lines. <br />on the following deseribed property: <br />Lct 29, Blk 558, Plat of Everett <br />commonly known a�s 2506 Or�nd. <br />The Board of Ad�uetment, following a publie hearing on said application held <br />on June 1, 1987, and further having reviexed all te�timony, makea the <br />folloxing Finding�, Conclusions and Order: <br />FINDINGS AND CONCLUSIONS: <br />That there have been exceptional or extreordinary circumetances or <br />conditione applying to the sub�act property or as to the intended use <br />thereof that do not apply genera].ly to other properties in the same <br />vieinity or zone. <br />a. Findings Item 9 of Special Property Use Permit �5-82, which <br />xaa granted to the applicant and updated 9/10/86 to allow a <br />mini-cenLer for child eare in a eingle family reaidence, <br />requiree that the applicant provide for employeea ^off-atreet <br />parking in the alley in the denignated parking area." <br />Furthermore, it requires that ^the applieants are to park at <br />leaat one of their vehicle� at this location." Theae <br />reQuirementa nnceasitate a txo-ear garage, and due to the lot <br />width of 25 feet, it ie necosaary to conatruct the Lwo-car <br />garage to the side property linee. <br />b. Coneluaion: Granting thie variance would allow the applicant <br />t� comply xith the parking requirementa of Special Property llse <br />/5-82. Theee requirements do not apply to other properties in <br />the area. <br />2. That aueh variance is neceseary for the preaervation and enjoyment of <br />a aub�tantial property right of Lhe appellant posee��ed by the ormer� <br />of other propertiea in the same viei.nity or zone. <br />a. FSndSng= The City encourages conetruetion of garagea to <br />provide for off-street parking. Several other homea in the <br />viQinity have been allowed to build garages to the rear <br />property line. The applicante oxn the ad�acent property to the <br />north, eo Lhey Will be able to provide neceseary maintenance to <br />Lhe atructure. However, they would need to obeerve a 3-foot <br />seGback along the eouth property line in order ta provide for <br />maintenance of the structure, or else obtain an easement from <br />the adjoining property owner for this purpose. <br />b. Conclusion: The variance would allox a property right <br />posnessed by other oxners in the vicinity. <br />
