J,�. .( , , <br />�varet��-eA-981�ot L <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.22.060(B), Side Yard, 79.22.060 (C), Rear Yard, and 19•42.040(D) Yarde to <br />alloa: <br />a two-car garage to be Duilt to the rear and side property linea. <br />on the following �eseribed property: i'�n+t' ������ 1,� <br />UU <br />Lot 29r Blk 558r Plat of Everett �UN 2; 1987 <br />commonly knorm as: 25oe Grand. CITY OF EVEREIT <br />The Board of Adjustment, folloxing a public hearing ot1-SA�d"��13"da"tion held <br />on June 1, 1987. and further having reviewed all testimony, makes the <br />follorring Findings, Conclusions and Order: <br />FINDINGS AND CONCLUSIONS: <br />1. Thet there have been exceptional or extraordinary cireumstanaee or <br />eonditions applying to the subject property or as to the intended uae <br />thereo!' that do not apply generally to other properties in the same <br />vioinity or zone. <br />a, Findlnss Item 9 of SpeQial Property Use Permit i5-A2� xhieh <br />waa granted to the applieant and updated 9/10/86 to allorr a <br />mini-Qenter for child care in a single family reaidence� <br />requires that the applicant provide for employeea "off-street <br />parking in the alley in the designated parking area." <br />Furthermore� it requires that "the applicanta are to park at <br />least one of their vehioles at this looation." Theee <br />requirements neceasitate a two-car garage, and due to the lot <br />width of 25 feet, it iy necessary to conatruet the two-car <br />garage to the side property linea. <br />b. Conclusion: Cranting this variance r+ould allorr the applicant <br />to comply With the parking requirementa of Special Property Use <br />�15-82. These requirementa do not apply to other properties in <br />the area. <br />2. That such varlance is necessary for the preservation and enjoymenE of <br />a aubstantial property right o£ the appellar.t possessed by the or+ners <br />of other properties in the same vicinity or zone. <br />a. Finding= The City encourages construetion of garagea to <br />provide for off-street parking. Several other homes in the <br />viclnity have been allowed to build garages to the rear <br />property line. The applicants own the adjacent property tu the <br />north, so they will be able to provide necessary maintenance Lo <br />the structure. However, they would need to obnerve a 3-foot <br />eetbaek along the souEh property line in order to provide for <br />maintenance of the structure� or elae obtaln an easement from <br />the adjoining property oaner for this purpose. <br />b. Conelusion: The variance would alloW a proporty right <br />poeaessed by other or+ners in the vicinity. <br />
