S. CONTRACTOR hereby agrees that if BANK charges any fee or service charge for maintaining said savings account puruuant to this agreement, it shall be his sole responsibility. BANK may deduct such fee, if any, from the accrued interest of the monies deposited in said account prior to disbursement of the funds pursuant to this agreement or deduct that rmountat the time of the disbursement. If said fee or service charge exceeds the amount of accrued interest and in the event the funds are disbursed to CITY, CITY shall be entitled to recover from CONTRACTOR the difference between the amount disbursed and the original amount of the security deposit as specified in paragraph two (2) above. 9. This agreement and any other pages or documents attached hereto and incor- porated by reference herein constitute the entire agreement with respect to the assignment of savings account between CONTRACTOR and CITY. This agreement shall be binding upon the assigns, successors, personal rep- resentatives and heirs of the parties hereto.
