FINDINGS AND DECISION <br />OF THE HEARING EXAMINER OF THE <br />CITY OF EVERETT <br />IN THE MATTER OF THE APPLICATION <br />OF RANDY UTl' AND MADDY METZGER-UTT <br />FOR APPROVAL OF A VARIANCE VARIANCE #09-001 <br />DECISION: The requested variance to allow a portion of a <br />fence at 719 Grand Avenue, Everett, Washington, <br />to exceed the six-foot height standard and to be <br />eight feet in height is granted subject to the <br />conditions as set forth herein. <br />INTRODUCTION <br />Randy and Maddy Melzger-Ull (Applicant) requested approval oi a variance from lhe <br />City o( Everetl height standards for fences in an R-1, Sinyle-Family Detached Low <br />Density zone. Specificaily, the Applicant requested a variance from Everett Municipal <br />Code (EMC} 19.39.070.A(1). The variance is requested for the property at 719 Grand <br />Avenue, Everetl, Washington (subject property). The fence has been constructed prior <br />to the securing of the variance. <br />A hearing was held before ihe Hearing Examiner of lhe City of Everett on June 25, <br />2009.
