Conclusion: There are unusual circumstances applying to <br />the property and use due to the desire to maintain the <br />architectural style of the home and still be able to <br />provide more living space for a growing family. <br />That such varia7ioe is necessary for the preservation and en- <br />joyment of a substantial property right of the appellant pos <br />sessed by the owners of other properties in the same vicinity or <br />zone. <br />a. F=ndina:_ There nre other residences in the area that <br />are two story with dormers. in addition, the height <br />limitation in this zone was reduced in January of 1988 <br />from 35 feet so there are other homes in the area that <br />exceed 28 feet in height. <br />b. �o cl��� Granting this variance will allow the <br />applicant a property right already possessed by others <br />in the vicinity and zone. <br />That the authorization of such variance will not be materially <br />detrimental to trie public welfare or injurious to property in the <br />vicinity or zone in wriich the property is located. <br />a. F�ndina: The proposed dormers are on the rear of the <br />house and will not block anyone's view. No adverse <br />comments have been received after notification of <br />property owners within 300 feet. <br />b. Go c�usion: Grantinq this variance will not be <br />detrimental to the public welfare or injurious to other <br />property in the vicinity and zone. <br />�ri�e`ripp NO. 47 <br />That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />a. �yndina: The comprehensive plan designation for this <br />area is single family detached and the use is the same. <br />b. �onclusion: Granting this variance would not adversely <br />affect the comprehensive plan. <br />[tSCOMSNDATION: <br />APPROVE the variance as requested by applicant with trie followiny <br />conditions. <br />1.
