Criterioe No. 3: <br />That the variance will only grant the subject property the same general <br />rights enjoyed by other property in the sanie area and zone as the subject <br />property. . <br />a. �ii1�g:. The applicant states that there are many examples <br />of other gazages built wiUun the 5;oot setback in the <br />neighborhood. The fact that there are so many exceptions <br />substaatiates the need for the request. (See Exhibit #6) <br />b. Conclusions: There are a number of gazages in the immediate <br />azea that do not meet the required 5 foot setback requirement. <br />The majority of these structures were established prior to 1956 <br />and aze considered "grandfathered" or legal non-conforming. <br />The zoning code allows for legal non-conforming gazage <br />structures to be rebuilt in the same location with the same or <br />greater setbacks. However, any proposed new garage <br />structures are required to meet the minimum setback <br />requirements. No variances have been granted for any new <br />gazage structures to havc a lesser setback than required by <br />zoning code in the azea of the subject property. <br />�iterioo No. 4• <br />That the variance is the minimum necessary to allow the subject property <br />the general rights described in Criterion 3. <br />a. EiIIlljpE�: See Criteria #3. <br />b. Conclusions: See Criteria #3 <br />Criterion No. 5• <br />The granting of the variance is consistent with the goals and policies of the <br />Everett General Plan. <br />a. Ejp�illg�: The Everett General Plan designates this property <br />as 1.2 Single Family Detached. <br />b. Conclusioas: The proposed use of the subject property is <br />consistent with the Everett General Plan. <br />Criferion No.�: <br />The need for the requested variance is not the result of a self-created <br />hazdship. <br />a. Findine�� The applicant has stated that the need for the <br />requested variance is not the result of a self created hazdship, <br />but is necessary to preserve the sensitive bluff azea that has <br />already been undermined by the gazage in its existing location <br />and to provide safe exit to the street from 920 Grand Avenue. <br />b.
