Criterion 3: That the authorization of such variance will not be <br />materially detrimental to the public welfare or injurious to <br />property in the vicinity or zone in which the property is <br />located. <br />a. Finding: There have been no adverse comments received from <br />property owners who were mailed notices of the application, <br />and there does not appear to be any view blockage. <br />b. Conclusion: The authorization of the variance should not be <br />materially detrimental to the public welfare or injurious to <br />other property in the vicinity or zone. <br />Criterion 4: That the granting of such variance will not adversely affect <br />the Comprehensive General Plan. <br />a. Finding: The Comprehensive Plan designates the area single <br />family. <br />b. Conclusion: The proposed carport is an accessory use to a <br />single family use and granting the variance will not <br />adversely affect the Comprehensive Plan. <br />NOW, THEREFORE, the Board of Adjustment of the City of Everett does <br />hereby order that the variance be GRANTED to allow an eight foot front <br />setback instead of the twenty feet required by code and further require the <br />applicant to meet the following conditions. <br />1. Obtain all necessary building permits. <br />2. The height of the structure shall not exceed 15 feet above the <br />natural topography of the abutting Bailey Street right-of-way. <br />The action of the Board of Adjustment in GRANTING a variance shall be <br />final and conclusive, unless within fifteen (15 days from the date of <br />issuance and signing of this order by the Chairman of the Board, an <br />aggrieved person or persons obtains a writ of certiorari from the Superior <br />Court of Washington for Snohomish County for the purpose of review of the <br />action taken. <br />DATED 'his C -� gay of CJr� v 1987. <br />Chairman, Board of Adjustment <br />Notes to Applicant: <br />1. If a building permit is not obtained within one year from the above <br />date, the Board's decision shall cease to be effective.
