Dippold <br />Carney Badley Spellman <br />701 Fifth Avenue, Suite 3600 <br />Seattle, WA 98104-7010 <br />dippoldi o carneylaw.com <br />Dear Mr. Dippold, <br />The following summary addresses the City's review of the stabilization and restoration r'.ans <br />submitted by Fredrick and l lolly Anderson. <br />Background: Fredrick and Holly Anderson are owners of the property located at 4704 Harbor <br />lane. The northern portion of the their property has a steep slope that extends downward <br />approximately 120 feel in elevation from an existing swimming pool to Merrill & Ring Creek <br />below. The lower portion of the slope extends onto a neighboring property. There has been a <br />recent landslide near the center of the northwest portion of the site. Prior to the slide, <br />approximately 38 trees were curt down and left on the slope. The entire slope is within a <br />required stream buffer per 19.37.170.B.1 of the Everett Municipal Code (EMC). <br />Proposed Restoration: Slope restoration is detailed in both the Geotechnical larginecring <br />Evaluation prepared by Nelson Geotechnical Associates, Inc., dated September 15, 2009 and <br />the Restoration Plan prepared by Wetland Resources, Inc., dated September 24, 2609. The <br />Planning Director has determined that the construction of a soldier pile wait pup to 14 feet tall of <br />exposed height from the eastern lot line extending approximately 130 feet near the top of slope <br />towards the westerly lot line is exempt from the buffer requirement per EMC 19.37.050.A.1. <br />This section exempts emergencies that threaten the public health, safety and welfare from the <br />provisions of Chapter 37, Critical Areas, provided that the exempted activity shall restore any <br />incidental damage to the critical area and that best management practices are implemented. <br />The Restoration and Stabilization Plans are approved subject to the satisfaction by the <br />Andersons of the following conditions: <br />1.
