PLANNING DIRECTOR DECISION <br />Review Process 1 /99.003 <br />April 9, 1999 <br />The City of Everett Planning Department's Director approves a request by Gary Mahan <br />to construct a single family residence up to 30.6 feet high within a stream buffer and the <br />25 foot front setback and to construct rockeries/retaining walls up to eight feet high <br />within the front setback at 48XX Harbor Lane (Lot 16) with the following conditions: <br />1. Provide a temporary fence immediately west of the proposed residence prior to <br />issuance of building permits. The location of the fence needs to be reviewed and <br />approved by the City of Everett. No native vegetation west of this fence may be <br />removed. Once the residence is completed, a permanent solid board, post and <br />rail, chain link, picket fence or other type of fence that is acceptable to the <br />Planning Department must be placed immediately west of the residence. An <br />Environmentally Sensitive Area sign must be posted on the fence. The signs are <br />available from the City of Everett permit services counter. <br />2. Provide a recorded Environmentally Sensitive Area Protective Covenant <br />protecting the area immediately west of the proposed residence prior to issuance <br />of building permits. <br />3. The applicant must prepare a covenant riming with the land which waives claims <br />against the City, its officers, employees and agents, and indemnifies (including <br />reasonable attorney's fees), defends and saves the City, its officers, employees <br />and agents harmless from any loss or damage to people or property either on or <br />off the subject property resulting from any form of soil movement whatsoever <br />and/or from any form of failure in design and/or construction of the <br />improvements thereon whatsoever. The owners of the subject property shall <br />provide the City with the covenant and it shall be signed and acknowledged by all <br />parties with an interest in the property. The covenant shall also provide notice <br />concerning the presence of environmentally sensitive features on the property. <br />The covenant must be presented to the City Attorney for review and approval <br />and, upon approval, recorded by the applicant with the Snohomish County <br />Auditor prior to the issuance of any construction permits for the subject <br />development. <br />4. Comply with all recommendations of the geotechnical study py Terra Associates, <br />Inc. dated December 3, 1998. The final foundation plans, rockeries/retaining <br />walls, and earthwork must be reviewed and approved by Terra Associates, Inc. <br />5. The height of the house is limited to 30.6 feet per the site plan submitted <br />April 6, 1999. <br />
