AGREEMENT <br />For and in consideration of NorCraft Building Co., Inc, providing a set -aside <br />letter (copy attached), which enables Rodger and Diane Petersen to obtain their <br />building permit to construct their residence at Lot #24 replat of Lot "X", <br />Darlington, the undersigned parties agree to the following: <br />1) NorCraft Building Co., Inc. will complete all road, underground <br />utility and drainage improvements for the extension of Lynnewood Drive <br />up to the proposed plat of Harbor Ridge. Said improvements shall be <br />determined solely by the city of Everett Building Department in compliance <br />with the city's code requirements. Said extension of Lynnewood Drive <br />is estimated to be completed by 7/15/84. <br />2) Rodger and Diane Petersen agree to keep all foundation forms, soil, <br />lumber, machinery and all miscellaneous construction related materials <br />within the boundaries of their property at all times so as not to <br />block, obstruct or impede the proposed roadway and improvements for the <br />extension of Lynnewood Drive by NorCraft Building Co. It is understood <br />that any obstructions or blockages could result in delay and additional <br />costs to NorCraft Building Co., Inc. and if so the Petersen's may be <br />held liable or responsible for additional costs on delay of construction <br />of the road or improvements. <br />3) Rodger & Diane Petersen are responsible for any building setback <br />requirements from the proposed road. NorCraft Building Co., Inc. <br />represents no boundary lines at this time,until determined by actual <br />survey and location fo the proposed roadway by Kecel & Assoc. -Engineers. <br />4) David A Brandvold and Judith Brandvold, his wife originally s <br />Lot 2 the Petersens and according to their "Purchase & Sa Agreement" <br />are response or the cost of stubbing in the undergro utilities <br />5' into the Peterse Lot 24, as required by the C' of Everett to <br />make it a legal buildable NorCraft Build' Co., Inc. agrees to <br />stub in the utilities 5' into Lo 4 at s time they are putting in <br />all the other related improvements extension of Lynnewood Drive. <br />It is estimated said cost tubbing ii`N;c underground utilities <br />will be $ , and id A & Judith B,randco ill pay that <br />estimated amount to raft Building Co., In.. at such No;Craft <br />commences with work on the road and utility extensions.
