BOARU OF ADJUSTMENT <br />FINDINGS� CONCLUSIONS AND ORDER <br />YAHIANCE N0. 1-87 <br />Based upon tlie Written request tor a variance from the Ciiy's zoning code by: <br />Steve and Norlanna Klein <br />4924 33rd Ave. E. <br />Everett, WA 98204 <br />hereinafter referred to as "Applicant,'" for a variance from E.M.C. <br />1:'.12.060, Height Limitations, to allow: <br />construction of a single family re::idence that would be 31 feet in <br />height instead of the 25 feet allowed by Code. <br />on the following described property: <br />Lot 9, Plat of HarUor Ridge <br />commonly ImoWn as: (number to be assi�ud) Harbor l,ane <br />The Hoard of Adjustment, following a public hearing on said application held <br />on March 2, 1987 and further I�aving revieNed ali testimony, makes tbi <br />Following Findings, Conclusions and Order: <br />FINDINGS ANU CON(:LUSIONS: <br />1. That there have been exceptional or ext[•aordinary circumstances or <br />conditions applying to the subjeut property or as to the intended use <br />thereof that do not apply generall;✓ to other properties in the same <br />vicinity or zone. <br />Finding: Al1 of the lots in the Plat of Harbor Ridge enjoy mountain <br />and water views to the north and east or west. Lot 9 is the highest <br />and most southerly parcel in this developcoent and so needs the <br />additional height to enjoy their vieu Which might otherwise be <br />blocked by structures to the north. Covenants on the plat limit <br />height of the structures on lots 1 through lots 8 to 24 feet in <br />height in order to protect their vieWs but does not place that <br />restriction on Lot 9• <br />To the east and West, Lot 9 is separated from other l�omes by ridges <br />and ravines and a disLance of 250 to 9('0 feet. <br />The property to the south is undeveloped timberland, presently not <br />accessed by existing roads, that will uLtimately gain access from the <br />south and would most likely orient to the east rather than uphill <br />towards �ot 9. In addition, the Southwest Everett Comprehensive Plan <br />designates the area to the south as Re:,idential (Attached/Detached) <br />8-12 dwelling units per acre with a transition area separating it <br />from the Harbor Ridge Plat to the north. <br />Conclusion: Oaing to the uniqueness of its location, elevation, and <br />separation from neighboring parcels, there are extraordinary <br />circumstances applying to Parcel 9 whi�h do not apply to its <br />northerly nelghbors or to other typical R-S parcels. <br />
