Baker, Port of Everett, Cascades), in the opposite direction from the <br />Kleins. <br />Owing to the uniqueness of its location, elevation, and separation <br />from neighboring parcels, we propose that there exist extraordinary <br />circumstances applying to Parcol 9 which do not apply to its <br />northerly neighbors or to other typical RS parcels. <br />Question 2-Preservation of Prooer�y Riaht <br />The plat map (Exhibit B) will illustrate that the top of a steep bank <br />establishes the eastern edge of the buildable site area for parcels <br />1-9 at Harbor Ridge. The development trend is for houses to be <br />located as far east as possible in order to access the northeasterly <br />view of Mt. Baker. One will notice that the alignment of the bank at <br />parcels 6,7, and 8 allows for each hcuse to move increasingly <br />easterly, providing views past one anotF�ar to the northeast. The <br />steep bank turns in direction at parcel 9, moving the logical <br />building platform further to the wast, suggesting that views to the <br />northeast will be obstructed by houses located on parcels 7 and 8. <br />The covenants (Exhibit A, Article 5.8) for Harbor Ridge take this fact <br />into account by providing that the height of parcel 9 should not be <br />constrained by covenant as are lots 1-8. Views at Harbor Ridge <br />therefore are property rights protected by height covenants on all <br />other similar parcels in the same vicinity, but these covenants are <br />specificaily waived at parcel 9, the Kleins' parcel, recognizing that <br />any house to be built on Parcel 9 might need to excesd the 25 foot <br />height limit in order to enjoy the same view rights. <br />Question 3-Detrimental to the P blic Welfare <br />As indicated by the narrative responses tc questions 1 and 2, the <br />public as well as ali other properties in the vicinity , will barely be <br />able to see the proposed Klein Residence, if at all. No views will be <br />obstructed, nor any other form of injury be inflicted on any party. <br />� _ •� ' ••� �- .u• -�- .� <br />There will be no affect upon the Comprehensive Plan. The proposed <br />use is acceptable under the zoning code. No exceptions to any <br />municipal code or ordinance is sought beyond the increase to the <br />height limit, Section 19.12.060. <br />
