EASEMENI' <br />This easement is grantcd subject to and conditioned upon the follo�ving terms, conditions and <br />covenants: <br />1. Grantor shall at all times conduct its activit Ps and all other activities conducted on <br />Grantor's property so as not to interfere with, obstruct or endanger the usefulness of any <br />improvements, or other facilities, now or hereafter maintained upon the easement, or in any <br />way interfere with, obstruct or endanger the City's use of the easement. <br />2. Prior ro �ny construction, work or any other activity by Grantor within the easement, <br />notification and plans for the same shall be submitted in writing to the City by Grantor and no <br />such construction, work or activity by Granror sl�all be commenced without City's prior <br />written agrecment that the Grantor's proposed construction, work or activity will not interfere <br />with A�c City's easement granted herein; PROVIDGD, HOWEVER, any changes or revisions <br />in the plans sliall also bc subject to City's prior agrcemenL The City's review of U�e Grantor's <br />plans undcr this casement shall not bc dcemed to imposc any duty or obligation on th� Ciry to <br />determine tl�c .idcquacy or sufficieucy of Grantor's plans and designs nor whetl�er Granror's <br />construction, work or activity is in conformance �vitlt other applicable plans, codes and <br />regulations. FurUier, agreement by the City to sucl� construction, work or activity shall not in <br />atty manner be considered as imposing any obligation, daty or liabilit}' upon the Ciry as to the <br />safcty or propricty of such construction, work or activiry. <br />3. Granton c�reUy �uthorizcs City to cut, trim and removc 1ny and all brush, trecs, <br />other vcgetation or debris upon the casement and Wc right of access for such purposes. <br />Grantor also authorizes the City to cut, trim and remove any and all brush, trees, other <br />vegctation and debris on Grantor's property �vhich, in the City's reasonable judgment, <br />constitutes a hazard to tlie eascment and tl�e right of access for such purposes. <br />t� <br />AF2005X0180536 � <br />
