City f Everett Planning Depart .zt <br />City Hall <br />Everett, Washington ^�. <br />VARIANCE PROCEDURE <br />The City of Everett Board of Adjustment is authorized by law to <br />conduct hearings and make findings and determinations therefrom <br />on applications for variances from the terms of the Zoning Code. <br />In granting such variances, the Board is required to consider each <br />of the £ollowing determinants: <br />(1) That because ef special circumstances applicable to <br />subject propexty, including size, shape, topography, <br />location, or surroundings, the strict application to <br />the Zoning Code is found to deprive property of rights <br />and privileges enjoyed by other properties in the vicinity <br />under identical zone classification. <br />(2) That the granting of the variance will not be materially <br />detrimental to the public welfare or injurious to the <br />property or improvements in the vicinity of a zone in <br />which subject property is located. <br />(3) That the denial of such variance request would continue <br />or result in an unnecessary hardship to the property <br />oWner, the cause of which was beyond his control. <br />t4) That any variance granted shall <br />conditions as will assure that t <br />authorized shall not constitute <br />privileges inconsistent with the <br />properties in the vicinity and z <br />property is situated. <br />be subject to such <br />he adjustment thereby <br />a grant of special <br />limitations upon other <br />one in which the subject <br />The action by the Hoard of Adjustment on applications for a variance <br />is £inal and conclusive, unless the original applicant or an adverse <br />party files an appeal to the Superior Court for a Writ of Certiorari, <br />a 1�Trit of Prohzbition, or a Writ of Mandamus. The filinq of such <br />appeal shall atay the effective date of the order of the Board of <br />Adjustment until such time as the appeal shall have been adjudiczted <br />or withdrawn. <br />(1) <br />(2) <br />(3) <br />(4) <br />REQUIREMENTS FOR FILING <br />Completion of a variance application form. <br />Completion of a PLOT PLAN (to a scale not less than 1" _ <br />100 ft.) to clearly show the dimensions of the property, <br />the location of existing and proposed buildings, signs, <br />curbs, etc., and the permanent measurements. <br />Filing fee of $15.OG. <br />PH[)TOGRAPHS of the property involved on a scale large <br />enaugh to illustrate the subjects under discussion are <br />always helpful to the Board of Adjustment and are suggested <br />as Exhibits with this application. <br />
