B. This Agreement sets forth conditions for access, use of the newly created Property <br /> and for the use of the west portion of the "parent" lot that will remain R-2. Specifically <br /> conditions are established herein limiting access to the Property from Evergreen Way only. <br /> Further, use of the Property will be limited to residential and education and that portion of the <br /> parent site, from which the Property will be created(facing Fleming), will be limited to R-2 uses <br /> only. It is the intent of these conditions to benefit the local neighborhood and the greater <br /> community; and <br /> C. This Agreement is entered into pursuant to RCW 36.70B.170, .180, and .190. <br /> This Agreement shall be construed in a manner that is consistent with applicable development <br /> regulations adopted by the City, except as modified herein; and <br /> D. The parties hereto agree that, as conditioned by this Agreement, Housing Hope <br /> satisfies the criteria for approval of the rezone of the property described herein to B-2 with the <br /> R-2 standards applying to west portion of the site from which the B-2 Property is created. <br /> PART ONE—PROPERTY USE <br /> 1.1 SEPA. The provisions of this Agreement are subject to the City's SEPA DNS <br /> determination (#01-042), which is incorporated herein by reference. <br /> 1.2 Restricted Use. Pursuant to Resolution No. 5/11, the Property is rezoned to B-2 <br /> subject to the following: (a)the short subdivision required to create the subject lot is finalized, <br /> (b) access to/from the subject lot is provided only from Evergreen Way, (c) use of the Property <br /> is limited to an educational facility, (d) up to 12 units of housing will be allowed, (e) the R-2 use <br /> 2 <br />
