The <br /> Everett Planning Director's decision of March 9, 2007, <br /> remains as issued. <br /> INTRODUCTION <br /> On March 9, 2007, the Everett Planning Director issued a decision aliowing a deviation <br /> from the roof pitch standards for the development of the property at 1134 Grand <br /> Avenue, Everett, Washington (subject property). The deviation allowed Scott Anderson <br /> (Applicant) to develop a new structure or�-site using 4:12 roof pitch on the east and west <br /> sloping roofs and 6:12 roof pitch for the other roofs of the proposed structure. On <br /> March 23, 2007, Mike Palmer, Bob Heavey, Eric and Mo Brinster, and Kristine and Tara <br /> Hudson (hereinafier referred to collectively as Appellant) filed an appeal of the Planning <br /> Director's decision. <br /> A prehearing conference was held before the Hearing Examiner of the City of Everett on <br /> April 5, 2007. At that conference it was stated that other appealable issues may arise <br /> with the application. The hearing was continue d until all administrative decisions had <br /> been made on the project. On May 21, 2007, the City issued another administrative <br /> decision approving the proposed structure and declaring that it was in compliance with <br /> all applicable zoning standards. No appeals were filed of that administrative decision. <br /> Accordingly, the only appeal before the Hearing Examiner is thal as set forth in the <br /> appeal letter of March 23, 2007. The issues of appeal are summarized as: whether the <br /> allowed deviation of lhe roof pitch for the proposed siructure at 1134 Grand Avenue was <br /> issued in error and thereby creaied issues of"mass pitch"; and, whether there was a <br /> lack of due process for the decision made by the Everett Planning Director. <br /> A hearing was held before the Hearing Examiner of the City of Everett on June 28, <br /> 2007.
