A roof pitch for a structure in <br /> such zone in Evereti is required to be a 6:12 pitch unless a deviation is issued. <br /> As part of the proposal submitted to the City, the Applicant sought a deviation <br /> and requested thal the easi and west roof slopes of the proposed structure have <br /> a 4:12 roof pitch. (Giffen testimony) <br /> 2. The City of Evereit enacted Ordinance No. 2547-01 on October 15, 2001. <br /> Section 11 of the Ordinance established standards for roof lines in Historic <br /> Overlay zones. Section 11 reads: <br /> All new buildings, including infill dweilings, shall feature <br /> roofs which slope a minimum of 6:12 vertical to horizontal <br /> ratio, and a maximum of 12:12 vertical to horizontal ratio, <br /> except for detached garages and building additions less <br /> than two hundred (200) square feet are not required to <br /> have pitched roofs if the design is compatible with the <br /> existing slruclure. <br /> In another section of Ordinance No. 2547-01, deviations from requirements of the <br /> underlying zoned district, including deviations from roof pitch standards, are <br /> ailowed (sea Ordinance No. 2547-01, Section 2(B)(1)(d)). (Ordinance No. 2547- <br /> U1, as provided in exhibit 7) <br /> 3. A deviation from the requirements of the underlying zone disirict is considered a <br /> deviation rather than a variance because it is not based on unusual <br /> circumstances or physical hardship, but on the quality of the proposed design. <br /> The proposed design is intended "to prorr�ote well-designed and innovative <br /> housing which may not slrictly comply with the established standards and <br /> guidelines, but which meets the intent of the Standards and Guidelines". <br /> (Ordinance No. 2547-01, Section 2(B),I <br /> 4. A deviation request of an applicant is considered by the Everelt Historical <br /> Commission (Commission). The Commission's authority is a "recommendation <br /> as a guide" to the Everetl Planning Director. (Ordinance No. 2547-01, Saction <br /> 2(8), as provided in exhibit 7) The recommendation is made based on <br /> consideration of: (a) the unique characteristics of the property and/or <br /> surroundings and how they will be protected and/or enhanced by lhe deviation; <br /> (b) the posici��e charackeristics of the proposed development and whether such <br /> characteristics could be provided by compliance with the standards and <br /> guidelines; and (c) whether the proposed design miligates the impacts that could <br /> be caused by deviation from the staidards. (Ordinance No. 2547-01, Section <br /> 2(8)(3), as provided in exhibit 7; and as quoted in exhibit 1, staf(report, page 3) <br /> 5. Because the proposed project is in an Historic Overlay neighborhood, the <br /> Commission was requirEd to review the project and ihe requested deviation.
