A roof pitch for a structure in
such zone in Evereti is required to be a 6:12 pitch unless a deviation is issued.
As part of the proposal submitted to the City, the Applicant sought a deviation
and requested thal the easi and west roof slopes of the proposed structure have
a 4:12 roof pitch. (Giffen testimony)
2. The City of Evereit enacted Ordinance No. 2547-01 on October 15, 2001.
Section 11 of the Ordinance established standards for roof lines in Historic
Overlay zones. Section 11 reads:
All new buildings, including infill dweilings, shall feature
roofs which slope a minimum of 6:12 vertical to horizontal
ratio, and a maximum of 12:12 vertical to horizontal ratio,
except for detached garages and building additions less
than two hundred (200) square feet are not required to
have pitched roofs if the design is compatible with the
existing slruclure.
In another section of Ordinance No. 2547-01, deviations from requirements of the
underlying zoned district, including deviations from roof pitch standards, are
ailowed (sea Ordinance No. 2547-01, Section 2(B)(1)(d)). (Ordinance No. 2547-
U1, as provided in exhibit 7)
3. A deviation from the requirements of the underlying zone disirict is considered a
deviation rather than a variance because it is not based on unusual
circumstances or physical hardship, but on the quality of the proposed design.
The proposed design is intended "to prorrote well-designed and innovative
housing which may not slrictly comply with the established standards and
guidelines, but which meets the intent of the Standards and Guidelines".
(Ordinance No. 2547-01, Section 2(B),I
4. A deviation request of an applicant is considered by the Everelt Historical
Commission (Commission). The Commission's authority is a "recommendation
as a guide" to the Everetl Planning Director. (Ordinance No. 2547-01, Saction
2(8), as provided in exhibit 7) The recommendation is made based on
consideration of: (a) the unique characteristics of the property and/or
surroundings and how they will be protected and/or enhanced by lhe deviation;
(b) the posicie charackeristics of the proposed development and whether such
characteristics could be provided by compliance with the standards and
guidelines; and (c) whether the proposed design miligates the impacts that could
be caused by deviation from the staidards. (Ordinance No. 2547-01, Section
2(8)(3), as provided in exhibit 7; and as quoted in exhibit 1, staf(report, page 3)
5. Because the proposed project is in an Historic Overlay neighborhood, the
Commission was requirEd to review the project and ihe requested deviation.
