"Geologicnlly Uaznrdous arcns" are kno�en by thc City and undcrsigned to be subjecl to landslides and other <br /> soils movement thnt may result iu tl�c damagc or dcstruction, in whole or in part, of any building, structure, <br /> dwclling,or lands within or adjaccnt to such arcas; and <br /> 1.5. T'his Declaration is to bc signed, acknowledged and rewrded in the rewrds of Snohomish County as n <br /> restrictive covenant, resvicting and limiting usc of gcologically hazardous property that shall run with the land, <br /> bcfore the City will issue any Pertnit(s)to do any work on property within a"geologically hnzardous area" <br /> SecNon Two• Restrictions on Occuaation Use and Develoament of thc <br /> Pro er <br /> 2.1. The Property may not bc occupicd, used or dcvelopcd, or residential or commercial building, swcmre, or <br /> d�vclling be crccted or constructcd on dic Property, «�ithout first obtaining thc Pemiit(s) from the City. <br /> 2.2. Thc City wiil not issuc nny Pcrniit(s) to O�wer of Property unlcss and until Owncr signs a contracmal <br /> agrecmenl(Agrocmenl)wilh�he Ciry cxpressly providing thaC <br /> 2.2.1. O�mers(s)and his/her(their)heir(s),suceessor(s), Iegnl rcprescntative(s)and assign(s)sliall providc, <br /> design, constn�ct, crect, m�inlain, repair, rcbuild, or improve such swcture(s), building(s), barriers(s), or <br /> dwelling(s) ns is rcasonably nccessary to prevcnt, control or avoid dnmage from the advene impacts from soils <br /> movcment within or ndjacent �o the Property, �ehethcr caused by Oa�ners(s)and his/hcr(lheir) heir(s),successor(s), <br /> legal reprecentative(s),and assign(s)or othcnvisc, for thc continucd use nnd enjoyment of the Property; <br /> 2,2.2. In considemtion of Ihe issuancc oC the Pem�it(s), Owner(s) on hisiher (their) own bchalf and on <br /> bchalf of his/her(thcir) hcin, successors, Icgal rcpresenlntives, and assigns hereby releases nnd waives any right to <br /> nsscrt any claim or course of action rclated to nny lo,s or dnmage to people or property cither on or off the Property <br /> resulling Gont soils movcmenl by reason of or arising out of issunnce oC the Pennit(s) by the Ciry for development <br /> on the Property and ngrecs to indcmnify (including rcasonnble attomcy's fecs) and hold thc City, its oCficers, <br /> employces nnd agents liarmless from nny claim(s) or courscs oC action related to any loss or damagc to people or <br /> property either on or off the Property resulting from soils movement by rcason of or arising out of issuancc of the <br /> Pern�it(s) for development on the Property; Provided, nothing hercin shall require the Owner(s) and his/hcr (their) <br /> heirs, successors, Icgal representntivcs, nnd assigns to indemnify and hald harniless the Ciry, its ofTicers,a�enls and <br /> cmployces Gom clnims or courses oC action caused solely by tl�c negligcnce of the City, its officer, emNloyces and <br /> agents, and provided Curlher, th�t iC tl�e claims or courses of nction are caused by or result Gom the wncucrent <br /> negligence of(I) the Owncr(s), hi,%her(ihcir) hcirs, successors, assigns and agents, and (2) the City, its officer, <br /> ngents and employecs, the indemnity provisions provided hcrein shall be vnlid and enforceable only to thc exrent <br /> provided by law; and <br /> 2.2.4.
