4 RESOLUTION NO. 5071 A RESOLUTION for WAIVING THE COMPETITIVE BIDDING REQUIREMENTS FOR THE SOLE SOURCE PURCHASE FROM Desso DLW Sports Systems for the purchase and installation of a DD Grassmaster turf reinforcing system for the Walter E. Hall soccer fields. WHEREAS,the city has recognized a deficit of soccer fields and desires to increase the playing capacity of its existing fields; and WHEREAS, vertical reinforcment of the turf at the Walter E. Hall soccer fields will provide an improved playing surface and permit a significant increase in the number of hours the fields can be in use; and WHEREAS, DD Grassmaster is the only natural turf reinforcing system that can be vertically injected into existing sand based natural turf and then be used immediately thereafter without need to reconstruct the field, re-seed, or resod; and WHEREAS, other natural turf reinforcing systems require construction,re-seeding, or re- sodding of the field after it is reinforced,taking the newly reinforced field out of play for at least a season; and WHEREAS,the combination of high demand for soccer fields and fewer fields than are needed means the City cannot take a field out of play for a season to install reinforcement; and WHEREAS, Desso DLW Sports Systems is the sole provider of the DD Grassmaster product; and WHEREAS, Desso DLW Sports Systems holds multiple patents in three major areas: 1)the unique machinery used to inject the fibers into the sand base, 2)the concept of vertically injecting reinforcing fibers, and 3)the material properties of the fiber used for reinforcement; and WHEREAS, FIFA,the international governing body for soccer has approved this system for play at the highest levels; and WHEREAS, Desso DLW Sports Systems is able to offer a considerable discount for the Walter E. Hall soccer fields project because the machinery is currently mobilized in the United States for other customers and the Walter E. Hall project will serve as a demonstration project, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT that because there is clearly and legitimately only one source capable of supplying a natural turf reinforcing system that can be vertically injected into existing turf and then be used immediately thereafter and because special market conditions exist that allow the City to purchase and installation of the turf reinforcing system at an exceptional value to the City , the City hereby waives competitive bidding requirements and authorizes the mayor to negotiate and execute a contract with Desso DLW Sports Systems.
