RESOLUTION NO. 5051 E!/E1iETT <br /> A RESOLUTION for WAIVING THE PUBLIC BIDDING REQUIREMENTS AND FOR THE <br /> SOLE SOURCE PURCHASE FROM Niagara Conservation Corporation for the purchase of <br /> 7,000 Summer Water Conservation Kits. <br /> WHEREAS, due to the unanticipated water situation and the state-wide call for water <br /> conservation, the City of Everett needs to purchase more summer water conservation kits for the <br /> regional water conservation program; and <br /> WHEREAS,the Everett Water Utilities Committee (EWUC) is comprised of the City's <br /> wholesale water customers and is particularly poised to encourage water conservation; and <br /> WHEREAS, the Niagara products were selected by the Everett Water Utilities Committee <br /> (EWUC) based on value, quality and durability, as well as the fact that they were aesthetically <br /> pleasing to homeowners; and <br /> WHEREAS,Niagara is the only vendor that carries all of the water conservation items selected <br /> to be included in the kits; and <br /> WHEREAS, it was anticipated that the 1800 Summer Water Conservation kits supplied by <br /> Niagara in March, 2001, would be all the kits required for this season; and <br /> WHEREAS, the City could not reasonably have anticipated the need for 7000 more kits that will <br /> need to be received and distributed in a very short time frame; and <br /> WHEREAS,Niagara also offers customized packaging and other features required for the water <br /> conservation program; and <br /> • <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> EVERETT that because there is clearly and legitimately only one source capable of supplying <br /> 7,000 additional Summer Water Conservation Kits when needed,the City hereby waives <br /> competitive bidding requirements and authorizes the Purchasing Manager to issue a Purchase <br /> Order for the Summer Water Conservation Kits. <br /> Council person Introducing -�ution <br /> PASSED and APPROVED this 30th day of May , 20 01 • <br /> David Simpson, Council President <br />
