4 <br /> 'UT 01100 EXHIBIT A <br /> UTILITY CONSTRUCTION AGREEMENT <br /> WORK BY STATE, ACTUAL COST <br /> SPECIAL CONSIDERATIONS <br /> The work proposed under this AGREEMENT provides for the STATE to cause to be performed the removal, <br /> relocation and/or construction of CITY-owned facilities. <br /> 1. SCOPE OF WORK <br /> The STATE shall install 35 lineal feet of 12" ductile iron waterline, 870 lineal feet of 24" ductile iron waterline, <br /> trenching, a butterfly valve, and an air release vacuum valve, within STATE-owned limited access right of <br /> way, including through the bridges being constructed as a part of the STATE's project 1-5 South Everett <br /> Freeway Station, pursuant to the plans and specifications as approved by the UTILITY. <br /> 2. UTILITY PROVISIONS <br /> • The bid set of Utility plans and special provisions for waterline removal, relocation and/or construction <br /> incorporated in the STATE's project contract are incorporated as if attached herein by this reference. <br /> 3. WORK BY CITY <br /> None for this agreement. <br /> 4. WARRANTY <br /> The STATE agrees to include in its project contract Special Provisions a requirement for the contractor to <br /> warrant and to obtain a Warranty Bond valid for a period of two (2) years, covering the work performed under <br /> this AGREEMENT. The Special Provision language relating to the warranty and Warranty Bond are attached <br /> hereto as Attachments 1 and 2 to Exhibit A and by this reference are made a part of this AGREEMENT_ The. <br /> STATE will also include a bid line item in the contract plans for the cost of the Warranty Bond. <br /> The STATE will cause to have the utility work separately bid as part of its overall construction project and <br /> such costs shall include the cost of all warranty work. <br /> 5. UTILITY CONSTRUCTION AGREEMENT SPECIAL PROVISIONS: <br /> A. The STATE agrees to provide the UTILITY with 30 days advance notice prior to the STATE's <br /> contractor starting work on the UTILITY's facilities. <br /> B. The UTILITY shall submit a punch list to the STATE's Project Construction Engineer prior to the <br /> UTILITY's final acceptance of the work The STATE's Project Construction Engineer's representative and the <br /> UTILITY's representative shall review the punch list, and any work deficiencies shall be corrected prior to <br /> UTILITY's final acceptance. <br /> C. The STATE agrees, as appropriate, to require that a representative of the Design Consultant, who <br /> worked on the utility design, be available for consultation during construction of the waterline. <br /> D. Upon 3 working days advance notice and in coordination with the STATE Project Construction <br /> Engineer and the STATE"s contractor, the UTILITY may perform normal maintenance and operations on its <br /> facility. If such operations affect the performance of the STATE"s contractor and the contractor makes a <br /> claim, the UTILITY agrees to be responsible for any costs of such claim to the extent caused by the UTILITY. <br /> Emergency repairs shall not require advance notice; however, the UTILITY must inform the STATE Project <br /> Construction Engineer of the emergency and its nature as rapidly as possible. If the emergency repair is <br /> outside of the time when STATE construction is occurring, the UTILITY shall also inform the Everett area <br /> STATE Maintenance Engineer of the nature and location of the emergency as rapidly as possible. <br /> 16 <br /> PAGE A-1 of 2 AGREEMENT UT 01100 <br />
