Location Preceding Action Attachments Department(s) Approval Amount Budgeted Expenditure Required Account Number(s): Budget Remaining Additional Required DETAILED SUMMARY STATEMENT: The Agreement for Settlement, Water Supply, and Water Delivery System with the Tulalip Tribes, executed on September 16, 2006 provides: "The Tribe and the City will manage the construction through a Joint Board, see RCW 39.34.030 (4)(a),that will develop a comprehensive mechanism mutually agreed upon by the Parties which will address, among other things,financial management, project budgeting, construction management,bidding, insurance issues, liability issues, payment schedules, and claims issues." The law referred above, allows an Interlocal Agreement creating a"Joint Board"composed of representatives from the City and the Tribes. This Interlocal Agreement creates a Joint Board entitled: "Tulalip and City Joint Board for Managing the Construction of the Everett to Tulalip Waterline". It consists of two representatives from each of the two entities. This Interlocal Agreement is the first step in a proposed series of steps towards the goal of constructing the water supply pipeline contemplated in the Agreement. Its first task is to develop and recommend a comprehensive mechanism to deal with the financing,planning and construction issues inherent in such a project. RECOMMENDATION (Exact action requested of Council): Authorize Mayor to sign the Interlocal Agreement establishing a Joint Board between the City and the Tulalip Tribes to implement § C. 1. of the September 16, 2005 Agreement for Settlement, Water Supply, and Water Delivery System with the Tulalip Tribes to develop a comprehensive mechanism to provide financial,project budget,construction management,etc. for the proposed water delivery system. 3
