„�:..;' <br /> ' NOTICE OF ,� <br /> PLANNING DIRECTOR DETERMINATION <br /> Review Process II #�b-97 <br /> INTRODUCTION: The City of Everett Plen�iing Department has received an applicalion from <br /> Emest Brown, 1401 Palm Ava., Everett, WA 98203 for an addition to his residence located at <br /> 1401 Palm Ave. The proposed addition is to add a yarege to the west side of the existiny <br /> residence. The existing residence structure has a non�onforming setbadc from the front <br /> (south) properry line of 15 feet rather than the 20 feet required under cuRent zoning code. <br /> fihe proposed garage addition would have a 17 foot setbadc nom the front property line rather <br /> than a 20 foot setback per current zoning code. Section 38.040 allows for the Planning <br /> Director to allow for the expansion of a structure which does not meet required setbedcs or <br /> height, provided that the expansion does not make the setbadc or height more nonconforming; <br /> thetnon r�iformity as bpeen certified by the Planning Depam ent�� �e ordinance; and that <br /> BACKGROUND: The propert� is located in the R-2, Single Family Residential Zone. The <br /> typical required setbacks are 20 from the front and rear property lines and 5' from the interior <br /> side property lines for a single family residence and accessory structures. There is an <br /> existing residence on the property which is located only 15 feet from the hont (south) property <br /> line. The residential structure was originally constructed in 1949 according to the Snohomish <br /> setbatcyk fossstructures om the f ont property nerbecame effect ve December 3�,1 gb6 uilding <br /> FINDINGS: The existing residence has a 15 foot setback from the front (south) <br /> property line. This structure's setback has been certified as a legal nonconforming setback <br /> (NCB #6-97). The applicant proposes to add a garage on to the west side of the existing <br /> residence with a 17 foot setback from the front property line. <br /> DECISION: The Planning Director has determined to allow for ihe proposed addition <br /> with a 17 foot setback with the following conditions: <br /> 1. Necessary building permits are to be obtained from the City of EveretYs Building <br /> Department prior to construction. <br /> Right to Appeal: The applicant or owner of property located adjacent to the subjed property <br /> or any propeRy owner who deems himself aggneved and will thereby suffer a direct impact <br /> from the proposal may appeal the Planning Directors determination as to whether or not the <br /> proposal should be permitted. My such appeal must be filed within fourteen (14) calendar <br /> days of the date specified below. Appeal forms are available from the Planning Department <br /> and must be submitted along wilh the required filing fee.
