Amendment No. 1 extended the time of performance of the contract from August 1,2005 to
December 31,2005,expanded the scope of work to reach 30%design and increased the budget by$134,558 for a total amount not
to exceed of$262,387. Amendment No.2 extended the expiration date to June 1,2006 to allow the City and Everett Community
College to address outstanding issues regarding project location, cost sharing and right of way ownership. These issues are still
being addressed. In the interim, the Federal Transit Administration(FTA)identified additional environmental work to be
completed before the project can proceed beyond 30%design and before the City and Everett Community College can finalize
outstanding project issues. To date approximately$192,452 has been expended.
The FTA has given written notice that the City has completed the required documents but there is still a 30-day period of review
before the FTA cam make a final determination. Staff recommends extending INCA's current contract to September 30,2006 to
provide more time for the FTA to complete its review and for the City and College to continue to address unresolved issues.
RECOMMENDATION:Authorize the Mayor to sign Amendment No.3 to Professional Services Agreement with INCA
Engineers, dated March 10,2005,for the North Everett Transit Center Project.
58
05-24-06 Council Agenda-NETC INCA Amendment3.doc
