ADJUSTt4BNT <br /> ORDER <br /> WHEREAS, theretofore, there was .filed with the City o£ <br /> Everett Planning Department on (date) July 28, 1975 an applica- <br /> tion for a variance of Section No. . 050 oi Everett Municipal <br /> Code Chapter 19.16 by (applicant) Robert F.stes (address) <br /> 823 ?ecks Drive, Everett, WA 98201 for (specific variance <br /> - requested) : <br /> Permission to build a carpurt and a£tached shon to ' <br /> within two (2) feet of the side nroperty line. The <br /> Code requires a minimum of five (5) feet. <br /> on the following described oroperty: <br /> Legal Description: ':he East 70 feet of the South <br /> 120 feet of Lot 21, Fairview <br /> . Heights <br /> Addre�s: 823 Pecks Drive <br /> AND: Y7HEREAS, (date) September 8 , 1975 was fixed as the <br /> date of hearing on said application and proper notice having <br /> been given as required by law, <br /> AND: WHEREAS, a public hearing was held on said date and the <br /> Board of Adjustment, aftez reviewing all testimony, made the fin�- <br /> ings that: <br /> 1. There are excep'.ional circumstances aoolying to the <br /> subject property that do not apply to other oroner- <br /> ties in the same vicinity; specifically, because of <br /> � the City' s recent widening of Pecks Drive there is <br /> little room for Mr. Estes to park his car. <br /> 2. Granting the variance will not be detrimental to the <br /> public welfare or injurious to other properties in <br /> the vicinity. <br /> 3. The variance is necessary for the oreser�ation and <br /> enjoyment of a substantial property right; specifi- <br /> cally, there are other carports in the area that are <br /> closer to the property line than the ordinance re- <br /> quires. <br /> 4 . The granting of the variance will not adversely <br /> affect the Comprehensive Land Use Plan. <br /> NOW, THEREFORE, based on the foregoing findings: <br /> BE IT ORDERED BY THE CZTY OF EVERETT BOARD OF ADJUSTMENT that said <br /> appiication be GRANTED: with the following stipulation: <br /> 1.
