MEMO <br /> ' T0: COUNCILMAN GIPSON <br /> FROMs MARIAN DENT, HOUSIN� INSPECTOR <br /> DATE: SEPTEMBER 15, 1992 � <br /> SUBJ : PROPERTY ON PECKS DR. g' �2� P� '� <br /> I talked with the complainant the fiirst time you calle� with <br /> this situation. � This is a civil matter and the city can ' t <br /> legally perform code enforcement of ary type. <br /> I did talk with the complainant and indicated to her that as <br /> a property owner she had her rights. I advised her that i1 <br /> her neighbor went onto her property and installed a fence on <br /> her property that she did not want or the fAnce would <br /> eventually cause her to loose property because cf it being <br /> placed so far inside her property line, she had a right to <br /> remove the fence and put it in her neighbors yard. <br /> I told her that if it were me and my neighbor placed a tence <br /> on my property , I would write him a letter requesting him to <br /> remove the fence fram my property within two weeks and if he <br /> failed to remove the fence, I would have it removed. I told <br /> her that if she wrote a letter to the neighbor, it should ga <br /> via certified mail return receipt requested and to keep <br /> copy of the letter for her records and attach the green <br /> receipt when it comes back to her. <br /> The complainant called again today and reqi.ested something in <br /> writing from me to back her ua on this. I P�plained once <br /> again that I could not do that as a city employee as this <br /> matter was not covered by any cod= within the city . I <br /> e�plained that the I was trying to help her �s a friend and <br /> not as a city employee, and that if this were my property how <br /> I would handle the situation with a letter. <br /> I told her that the State Laws ( the RCW) would be the codes <br /> that would help her in this matter and that she migtit fiind <br /> out more information from the State Atty . General ' s Otfice <br /> which is located here in Everett. Obviously , her attorney <br /> isn ' t helping her and she is reluctant to go to another <br /> attorney . <br /> I don" t think I could help here much any more except to � <br /> listen to her problem. I don ' t know if I helped her or <br /> hindered a resolution to the problem. <br />
